MINUTES


Rep. Andy Westerberg, Chair of the Regulated Industries – Gaming Division, called the eighth meeting to order at 10:00 p.m. on March 10, 2006 in Room 5 of the State Office Building.

The Clerk noted the roll.

Members of the Committee:

A quorum was present.

Rep. Westerberg addressed the committee regarding the format for the Gaming Division meeting.

Mark Shields, Assistant Director of the Gambling Enforcement Division of Public Safety addressed the committee.

There was a discussion of financial audits and tribal compliance.

Tom Barrett of the Gambling Control Board, provided the committee with an overview of the FY05 Financial Summary for Licensed Gambling Organizations.

HF 2908 (Seifert) Allowable gambling expenses restrictions modified and technical changes provided.

Rep. Westerberg announced that HF 2908 was pulled from the agenda at the request of the author.

HF 3194 (Westerberg) Lawful gambling clarifying, conforming, and technical changes provided; and expenditure restriction requirements modified.

Rep. Westerberg moved that HF 3194 be recommended to pass and be referred to the committee on Regulated Industries.

Rep. Westerberg provided an overview of HF 3194 to the committee.

Elisabeth Long, House Research, provided further information to the committee pertaining to HF 3194.

Rep. Westerberg renewed the motion that HF 3194 be recommended to pass and be referred to the committee on Regulated Industries. THE MOTION PREVAILED.



HF 3099 (Westerberg) Electronic horse race wagering authorized, and card club provisions modified.

Rep. Westerberg provided an overview of HF 3099 to the committee.

Elisabeth Long, House Research, provided additional information regarding HF 3099 to the committee.

Rep. Westerberg moved that HF 3099 be recommended to pass and be referred to the committee on Regulated Industries.

Rep. Zellers welcomed Rep. Richard Brown from the North Dakota legislature as a visitor to the committee.

Rep. Westerberg renewed the motion that HF 3099 be recommended to pass and be referred to the committee on Regulated Industries.

Rep. Atkins raised the point of statute v. constitutional amendment.

Rep. Westerberg renewed the motion that HF 3099 be recommended to pass and be referred to the committee on Regulated Industries.

A division was requested on HF 3099. There being 4 Ayes and 4 Nays: THE MOTION DID NOT PREVAIL.

HF 3100 (Beard) Card club provisions modified.

Rep. Beard provided an overview of HF 3100 for the committee.

Rep. Westerberg moved that HF 3100 be recommended to pass and be referred to the committee on Regulated Industries.

The Gaming Division stood in recess until 1:00 p.m.

The Gaming Division reconvened at 1:30 p.m.

Rep. Beard provided closing comments on HF 3100 to the committee.

Rep. Westerberg renewed the motion that HF 3100 be recommended to pass and be referred to the committee on Regulated Industries. THE MOTION PREVAILED.

HF 2719 (Erickson) Card club table limitations eliminated.

Rep. Westerberg announced that HF 2719 was withdrawn from the agenda at the request of the author.




HF 3101 (Buesgens) Gambling other than parimutuel betting authorized at licensed racetrack, and constitutional amendment proposed.

Rep. Zellers moved that HF 3101 be recommended to pass and be referred to the committee on Regulated Industries.

Rep. Buesgens provided the committee with an overview of HF 3101.

Rep. Westerberg renewed the motion that HF 3101 be recommended to pass and be referred to the committee on Regulated Industries. THE MOTION PREVAILED.

HF 3099 (Westerberg) Electronic horse race wagering authorized, and card club provisions modified.

Rep. Zellers moved that HF 3099 be brought before the committee for reconsideration. THE MOTION PREVAILED.

Rep. Zellers moved that HF 3099 be recommended to pass and be referred to the committee on Regulated Industries. THE MOTION PREVAILED.

Closing comments by the Chair regarding the Gaming Division schedule.
