MINUTES


Representative Mark Olson, Chair of the Local Government Committee, called the forty-second meeting to order at 12:36 P.M. on Monday, March 27, 2006, in Room 10 of the State Office Building.

The clerk noted the roll.

POPPE, Jeanne moved the Minutes of March 23, 2006 be approved as corrected by the clerk. THE MOTION PREVAILED


HF3380 (Buesgens) Postemployment benefit account establishment by political subdivisions for officers and employees authorized.

OLSON, Mark moved HF3380 be recommended to pass and be re-referred to the Committee on State Government Finance.

At the request of the Chief Author, OLSON, Mark moved to recommend HF3380 be amended as follows:

The Olson Motion Prevailed.

The following provided testimony on and responded to the committee’s questions regarding HF3380 as amended:

ANDERSON, Bruce moved to recommend HF3380 be further amended as follows:

The Anderson Motion Did Not Prevail.

There being no further testimony, pro or con, the question reoccurred on the Olson Motion as amended to recommend HF3380 be amended and when so amended be recommended to pass and be re-referred to the Committee on State Government Finance. THE MOTION PREVAILED


HF3391 (Beard) Building and environmental permit timeline agency action established.

OLSON, Mark moved HF3391 be recommended to pass.

At the request of the Chief Author, OLSON, Mark moved to recommend HF3391 be amended as follows, and when so amended be recommend to pass and be re-referred to the Committee on Governmental Operations and Veterans Affairs:

The Chair called Representative Hilstrom to the Chair.

The following provided testimony on and responded to the committee’s questions regarding HF3391 as amended:

HF3876 (Finstad) County expenditure limit removed for soldiers' rest cemeteries.

HOLBERG, Mary Liz moved to recommend HF3876 pass and be placed on the Consent Calendar.

Representative Brad Finstad provided testimony on and responded to the committee’s questions regarding HF3876.

Representative Olson resumed the Chair.

There being no further testimony, pro or con, the question reoccurred on the Holberg Motion to recommend HF3876 pass and be placed on the Consent Calendar. THE MOTION PREVAILED.


HF3887 (Mullery) Hennepin County; Victory Memorial Drive Historic District restoration task force established.

HORNSTEIN, Frank moved to recommend HF3887 pass and be re-referred to the Committee on Governmental Operations and Veterans Affairs.

At the request of the Chief Author, OLSON, Mark moved to recommend HF3887 be amended as follows:

Page 2, line 15 delete “20…” and insert “2009”

The Chair called Representative Hilstrom to the Chair.

The Olson Motion Prevailed.

The following provided testimony on and responded to the committee’s questions regarding HF3887 as amended:

Representative Joe Mullery; and Pierre Willette of the City of Minneapolis, Room 301M, 350 5th St S, Minneapolis, MN, 55415.

There being no further testimony, pro or con, the question reoccurred on the Hornstein Motion as amended to recommend HF3887 be amended, and when so amended be recommended to pass and be re-referred to the Committee on Governmental Operations and Veterans Affairs. THE MOTION PREVAILED


HF3779 (Urdahl) Adults-only businesses required to give notice to a city or county of intent to conduct business, and zoning authorities granted.

HOLBERG, Mary Liz moved to recommend HF3779 pass.

At the request of the Chief Author and without objection regarding Committee Rule 6, HOLBERG, Mary Liz moved to recommend HF3779 be amended as follows:

The Holberg Motioned Prevailed.

Representative Dean Urdahl provided testimony on and responded to the committee’s questions regarding HF3779 as amended.

Representative Olson resumed the Chair.

There being no further testimony, pro or con, the question reoccurred on the Holberg Motion as amended to recommend HF3779 be amended, and when so amended be recommended to pass. THE MOTION PREVAILED


Without objection the meeting was recessed to the Call of the Chair.

The forty-second meeting was reconvened by Representative Mark Olson, Chair of the Local Government Committee, at 5:17 P.M. in Room 10 of the State Office Building.


HF3452 (Hilstrom) Aitkin County regulation of certain public land interests repealed.

Without objection the Hilstrom Motion to recommend HF3452 pass was taken from the table and again before the committee.

HILSTROM, Debora moved to recommend HF3452 be amended as follows:

(see H3452A1 attached with the following correction:

Page 2, add a line 6 to read “Amend title accordingly”

The Hilstrom Motion Prevailed.

The question reoccurred on the Hilstrom Motion as amended to recommend HF3452 be amended, and when so amended be recommended to pass . THE MOTION PREVAILED.

Page 1, line 6 after “towns” insert “is encouraged”
