MINUTES


Representative Buesgens, Chair of the Education Policy and Reform Committee began the twenty-first meeting at 10:09AM on Friday, April 1, 2005, in Room 200 of the State Office Building.

The Clerk noted the roll.

HF962 (Abeler): Acoustical performance criteria included in school district proposal to construct a facility.

Rep. Abeler presented HF962.

Rep. Buesgens, Chair of the Education Policy and Reform Committee, officially called the meeting to order at 10:12AM. A quorum was present.

Rep. Abeler moved that HF962 be recommended to pass and be re-referred to the committee on Education Finance.

Rep. Buesgens moved that HF1312 be recommended to pass and be re-referred to the committee on Education Finance.

Rep. Buesgens renewed his motion that HF1312 as amended be recommended to pass and be re-referred to the committee on Education Finance. THE MOTION PREVAILED.

HF2132 (Gazelka): Student eligibility maintained when participating in Minnesota State High School League activities in another district during a teachers’ strike.

Rep. Buesgens moved that HF2132 be recommended to pass and be placed on the general register.

Rep. Gazelka presented HF2132.

Rep. Buesgens moved the A05-0456X amendment to HF2132. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Buesgens laid over HF2132 for future consideration.

HF1769 (Hornstein): No Child Left Behind Act and other student testing laws evaluated by the Office of Educational Accountability.

Rep. Buesgens moved that HF1769 be recommended to pass and be re-referred to the committee on Education Finance.

Rep. Hornstein presented HF1769.

HF2132 (Gazelka): Student eligibility maintained when participating in Minnesota State High School League activities in another district during a teachers’ strike.

Rep. Buesgens moved to reconsider HF2132.

Rep. Buesgens moved to amend HF2132 by the following oral amendment:
Delete all language of the A05-0456X amendment to HF2132 and insert “Any student who transfers to another district under this subdivision continues to be fully eligible for all league activities.”
THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

HF1016 (Ozment): Pupil Fair Dismissal Act provisions applied to students whose parents refuse to consent to an initial evaluation.

Rep. Buesgens moved that HF1016 be recommended to pass and be placed on the general register.

Rep. Buesgens moved the H1016A2 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Ozment presented HF1016, as amended.

Rep. Buesgens moved to withdraw the H1016A2 amendment. THE MOTION PREVAILED.

Rep. Buesgens amended the H1016A2 amendment orally as follows, and incorporated it into the amendment:
Line 2, insert after “after”, “the second”.

Rep. Buesgens moved the H1016A2 amendment, as amended. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Buesgens renewed his motion that HF1016, as amended, be recommended to pass and be placed on the general register. THE MOTION PREVAILED.

HF1856 (Tinglestad): Law enforcement teachers required to be licensed as peace officers.

Rep. Buesgens moved that HF1856 be recommended to pass and be placed on the general register.

Rep. Buesgens moved the A5-0383 amendment to HF1856. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Buesgens amended his motion to be that HF1856 be recommended to pass and be re-referred to the committee on Education Finance. THE MOTION PREVAILED.

HF1551 (Holberg): Student survey notice requirements provided.

Rep. Buesgens moved that HF1551 be recommended to pass and be re-referred to the committee on Civil Law.

Rep. Buesgens moved the following oral amendment to HF1551:
Page 1, line 10, delete “a student’s parent or guardian” and insert “a parent or guardian of a minor or dependent child”.
THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

HF1948 (Holberg): Public school employee usage of public funds and resources to promote or defeat a political candidate or question prohibited.

Rep. Holberg presented HF1948.

Rep. Buesgens moved the following oral amendment to HF1948:
Page 1, line 15, delete “promote” and insert “pass, elect”.
Page 1, line 24, delete “, so long as the employee does not promote or oppose the”
Page 1, line 25, delete “candidate or question”.
Page 2, lines 5 and 6, delete “the day following final enactment” and insert “January 1, 2006”.
THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Buesgens moved that HF1948 be recommended to pass and be placed on the general register.

Rep. Buesgens then moved the following oral amendment to HF1948:
