MINUTES



Representative Jeff Johnson, Chairman of the Civil Law and Elections Committee, called the fourteenth meeting to order at 12:40 PM on Monday, March 14, 2005, in Room B of the State Office Building.

The Clerk noted the roll.

A quorum was present.

Representative Pete Nelson moved approval of the March 9, 2005 Civil Law and Elections Committee minutes. THE MOTION PREVAILED. THE MINUTES WERE ADOPTED.

Chairman Jeff Johnson moved HF1204 (Holberg), Department of Transportation data classified, be recommended to pass and re-referred to the General Register.

Chairman Johnson moved the following oral amendments (see attached):

Page 1, line 18, add a common after the word "criteria,"
Page 3, after line 6, insert "Section 5, effective date application Sections 1 to 4 are effective the day following final enactment

Chairman Jeff Johnson renewed his motion that HF1204, as amended, be recommended to pass and re-referred to the General Register. THE MOTION PREVAILED.

Representative Brod moved HF271, imposing certain requirements on presidential electors and the secretary of state, be recommended to pass and be held over for possible inclusion in the Omnibus Elections bill.

Representative Brod moved the H0271DE1 amendment. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Brod presented HF271.

Representative Brod renewed her motion that HF271, as amended, be held over for possible inclusion in the Omnibus Elections bill. THE MOTION PREVAILED.

Representative Hilty moved HF470, Human rights act tolling provision established for the 12-month determination requirement, be recommended to pass and re-referred to the General Register.

Representative Hilty moved the following oral amendment:

Page 5, line 23, after the word "notify," insert the words "those who are"

Chairman Johnson incorporated the amendment into the bill.

Representative Hilty presented HF470.

Representative Hilty moved HF476 Human rights agency technical changes provided, be recommended to pass and re-referred to the General Register.

Representative Hilty moved the following oral amendments:

Page 2, lines 27 through 29, delete "written documents, audo and video tapes, or other electronically and technologically created or transmitted data,” and insert, Government data"

Page 2, line 29, delete "gathered" and insert "collected"
Page 29, lines 15 through 21, delete the existing language

Chairman Johnson incorporated the amendment into the bill.

Representative DeLaForest moved HF1325, be recommended to pass and re-referred to Public Safety. Representative DeLaForest offered an oral amendment, as follows:

Page 1, line 21, after the word "loss" insert a period and strike the words "of money or property, real or personal" THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Westrom assumed the gavel at 2:20PM.

Representative DeLaForest renewed his motion that HF1325, as amended, be passed and re-referred to Public Safety. A voice vote was taken; a division was called. The vote was 6 to 5. THE MOTION PREVAILED.

Representative Ellison moved HF1566 campaign workers allowed to access multiple unit dwellings unaccompanied by a candidate, be passed and re-referred for possible inclusion in the Omnibus Elections bill.

Testifying in opposition of HF1566: Jack Horner, Minnesota Multi-Family Housing Assoc.

Representative Ellison offered the following oral amendment:

Page 1, line 16, after the word “worker” delete “if the candidate” and insert “
“authorized in writing by the candidate”

A voice vote was taken. THE AMENDMENT WAS ADOPTED.

Representative Ellison renewed his motion that HF1566 be passed and held over for possible inclusion in the Omnibus Elections bill. THE MOTION PREVAILED.

The meeting was adjourned at 2:30 PM.
