House accepts clarifications proposed by Workers Compensation Advisory Council

Suggested changes to law put forward by the Workers’ Compensation Advisory Council are addressed in HF2478, passed 130-0 by the House Thursday.

The bill would clarify the process for attorneys claiming payment of legal fees in workers compensation cases and eliminate the bond requirement for those appealing a decision to the Minnesota Supreme Court made by the Minnesota Workers’ Compensation Court of Appeals.

It would also extend the deadline for compliance to Jan. 1, 2017, the requirement that health care providers and insurers electronically submit medical records and reports along with a medical bill. “Small and large providers have asked for additional time to put this together,” said Rep. Tony Albright (R-Prior Lake), the bill’s sponsor.

Rep. Tim Mahoney (DFL-St. Paul) successfully amended the bill to clarify the employer liability for treatment of claimants being treated at small hospitals, those with 100 or fewer licensed beds.

Considered a “housekeeping bill,” it now moves to the Senate where Sen. Dan Sparks (DFL-Austin) is the sponsor.

The Workers' Compensation Advisory Council was created in 1992 to recommend legislation pertaining to workers' compensation.
