Minnesota House Passes Conference Committee Report on Bill Banning BPA in Children’s Food Containers

St. Paul, Minnesota — Today the Minnesota House of Representatives passed the conference committee report on HF 459, a bill that bans bisphenol-A (BPA) in children’s food containers. The report passed on a bipartisan 114-13 vote. Once the Senate passes the conference committee report, the bill will go to Governor Dayton for his signature. The bill was chief authored in the House by State Representative Joe Atkins (DFL – Inver Grove Heights).

The bill is an extension of the current statute that bans BPA in children’s bottles and cups. HF 459 prevents manufacturers and wholesalers from selling infant formula, baby food or toddler food in containers made of materials which have had BPA intentionally added. A year after that ban takes effect, retailers become subject to the same ban. The bill defines “infant formula,” “baby food” and “toddler food,” with the latter defined as food or liquid that is primarily intended for consumption by children 3-years old or younger. The bill defines “container” as a receptacle, box, can or jar that comes in direct contact with a child’s food. Lastly, HF 459 states that manufacturers cannot replace BPA with a “chemical of high concern” as designated by any State, federal or international agency.

“This is a simple bill to give parents the peace of mind that the food they are feeding their children does not contain BPA,” said Rep. Atkins. “It’s just common-sense to protect our children from dangerous chemicals and I’m pleased the bill received such broad bipartisan support.”
