REP. DENNIS SMITH STATEMENT ON AMERICAN DISABILITIES ACT LEGISLATION

ST. PAUL, MN— In response to small businesses facing lawsuits over compliance with the American Disabilities Act (ADA), Representative Dennis Smith, R-Maple Grove, plans to sponsor legislation to protect businesses attempting to become compliant. Many organizations around the state have faced civil action for a possible lack of adherence to the ADA. Should this bill pass into law, businesses would have a reasonable amount of time to become compliant before civil action could be filed. Rep. Smith issued the following statement on the bill he will author:

“I believe that all of our businesses and local organizations should be in compliance with federal and state law, and should be accessible for those of all abilities,” said Smith. “If a business’s compliance is brought into question, they should have ample opportunity to make the necessary changes in order to adhere to the law. They shouldn’t be faced with a civil lawsuit by lawyers looking to make a quick dollar from a settlement. It’s important to protect our small businesses from litigation meant to hurt our main-street shops.”

Rep. Smith is working with a variety of organizations and groups to ensure that all parties are properly represented in the bill language.

“I recently spoke at an event for the Minnesota State Council on Disability (MSCOD) about this very legislation,” said Smith. “The MSCOD has been very helpful in understanding the needs and challenges of those with disabilities. Along with MSCOD, I’ve had input from the Minnesota Chamber of Commerce to help address this issue that impacts our local businesses.”
