ST. PAUL – A bill chief-authored by State Representative Joe Schomacker (R-Luverne) that redefines the moratorium on nursing home beds has been approved by the Minnesota House of Representatives.
“There are situations when nursing homes should not be required to follow a restrictive formula, and this bill addresses those concerns,” Schomacker said.
This legislation allows the Commissioner of Health to approve the addition or removal of nursing home beds for licensed nursing home facilities when some or all of residents are evacuated due to a natural disaster. It also eliminates the surcharge and provides flexibility in the accounting of nursing facility beds in times of emergency and recovery.
Schomacker’s bill further outlines reform by allowing an exception to the nursing facility bed moratorium through a hardship area designation and allowing certification of new beds in hardship areas. Hardship areas can be declared where a high level of out-migration occurs, a low number of beds and a lack of non-institutional services exist in a specified geographic area and other factors.
“I’m hopeful this legislation minimizes stress levels that nursing home patients and their care givers may experience in the aftermath of a natural disaster,” Schomacker said. “It should also allow nursing facility providers to consider sensible options for different types of health care delivery options and improved safety, quality of life and privacy considerations for patients.”
