Dear Neighbor,
I would like to share with you a legal victory for child care providers and small, independent businesses in Minnesota. Ramsey County District Court Judge, Dale B. Lindman, on April 6th, 2012, ruled Governor Dayton's Executive Order 11-31 to unionize child care providers as "null and void" (See attached summary judgment, page 8). Page 7 of Judge Lindman's judgment states, "By Executive Order 11-31, the Governor is attempting to circumvent the legislative process and unionize child care providers by executive order, rather than by adhering to a valid legislative process. In doing so, the Governor has improperly superseded the Legislature's authority and violated the separation of powers clause as set forth in the Minnesota Constitution." Judge Lindman's judgment permanently forbids the implementation and election process directed by Executive Order 11-31.
I heartily thank and congratulate the child care providers who courageously stood up to the governor's attempt to unionize their businesses against their will.
