House Passes Rep. Lohmer’s Bill that Protects Child Care Assistance Funds
Legislation would prohibit the deduction of union dues from state subsidy payments

St. Paul – The House today passed legislation by Representative Kathy Lohmer (R-Lake Elmo) that would protect child care assistance funds from the deduction of union dues or fees.

“We have heard time and time again from providers that child care assistance payments need to be delegated solely to child care assistance,” Representative Lohmer said. “In the event of child care unionization, union dues and fees should not be withdrawn from state child care subsidies prior to the providers receiving them.”

Representative Lohmer authored House File 1766 in response to Governor Dayton’s recent executive order calling for a vote on unionizing all private, independent in-home child care providers. Unlike federal law, current state statute lacks language that would protect a diversion of state subsidy funds to union dues and fees. The bill establishes a layer of protection that maintains the integrity of Child Care Assistance Program (CCAP) money.

House File 1766 has received strong support from child care providers, concerned that the deduction of dues would require them to stop enrolling child care assistance families or to make drastic cuts to their child care programs.

“This bill is very important for child care providers around the state,” Representative Lohmer explained. “They want to have the freedom to decide how to pay for dues, should unionization occur. We must remember that, in our current economic climate, we need to alleviate families’ financial burdens, not exacerbate them.”

Senator Ted Lille (R-Lake Elmo) carries a companion in the Senate.
