LEGISLATIVE UPDATE

News From Representative Fabian


On Thursday the TB Bovine tax credit bill I have authored was heard and passed in the House Agriculture Committee. This bill is very important to producers in the area that are still affected by the restrictions still in place in spite of achieving TB free status.

Coming into the session this was one of the top priorities of small businesses in Minnesota. On Wednesday a press conference was held to send the TORT Reform bills to Governor Dayton’s desk. Passing these Tort bills would help to also bring Minnesota into conformity with other surrounding states. These bills will reduce the burden for businesses that incur unnecessary costs from litigation. We are giving them more tools to be able to hire more Minnesotans, and that is a win-win for our economy and all Minnesotans. Unfortunately, the governor vetoed these bills on Friday.

The reforms include:
• Senate File 429 requires courts to consider the reasonableness of attorney fees in relation to the amount of damages awarded, and the amount of damages sought compared to the amount of damages awarded.
• Senate File 149 enacts class action lawsuit reforms, including the authorizing an appeal of right for the certification of a class action before expensive discovery costs are incurred. It also increases the conciliation court jurisdictional limit from $7,500 to $10,000 and raises the cap for consumer credit claims from $4,000 to $5,000.
• Senate File 373 shortens Minnesota's general statute of limitations from six years (currently the longest in the country) to four years.
• Senate File 530 lowers the prejudgment interest rate on awards and judgments from the current (and elevated) 10% flat rate to a market-driven rate with a floor of four percent.

We also voted on Thursday to pass House File 1766, which would prohibit union dues from being deducted from state subsidy payments to child care providers if a union were to form among providers.
