SESSION UPDATE

News From Representative Fabian


Friends –

As we are winding down this session, bills continue to move through committee and our conference committees continue to meet to come to a final bill to send to the Governor’s desk.

I presented House File 1497 last week in the Government Operations Committee. This bill says that The Pollution Control Agency should extend permit terms from 5 years to 10 years in order to coincide with site capacity, design capacity, ultimate capacity, or design life as determined by the proposer, if the permit is pertaining to a solid waste land disposal facility. This proposal was brought to me in part, by Dale Nelson the Mar-Kit landfill manager.

Rep. Rep. Steve Drazkowski has introduced a bill that would require a super-majority of the legislature to increase taxes, just as bonding (borrowing money) requires a super-majority to pass. A super-majority would be 81 votes in the House. Requires a three-fifths vote by each house of the legislature to enact a law that:

• Increases the general rate of an income or sales tax
• Increases the tax base of an income or sales tax
• Increases property taxes
• Enacts a new statewide tax of any type

House File 1467 is a bill that is important to gun owners and law enforcement. It directs the Minnesota Department of Human Services and Minnesota Courts to provide certain additional individual level data to the appropriate Minnesota and Federal agencies that support Minnesota law enforcement officials doing background checks on persons applying for a Minnesota permit-to-purchase a pistol or a Minnesota permit-to-carry a pistol. It also changes from one-year to five-years the effective period for the permit-to-purchase. Finally, it mandates an annual progress report to the Legislature by the Department of Human Services.

House File 1238 regarding rural septic systems continues to move through committee and will be included in the final Energy, Environment and Natural Resources Omnibus Bill. This bill will save money for our rural counties and homeowners. As we continue to work with rural counties and the legislature on this issue please don’t hesitate to contact my office with questions or comments.
