Rep. Winkler: Court Decision Degrades Quality of Democratic System


(ST. PAUL) — Today, a federal appeals court, in a split decision, rejected on constitutional grounds a Minnesota law requiring the disclosure of corporate political donations and spending.

State Representative Ryan Winkler (DFL – Golden Valley) was the chief author of the law in the Minnesota House and released the following statement:

“Today, the Eighth Circuit Court of Appeals ruled that Minnesota's law requiring corporation to disclose when they spend money to elect candidates is likely unconstitutional. This follows the U.S. Supreme Court ruling in Citizens United that corporations are people and have the constitutional right to spend money to elect candidates. Both of these decisions degrade the democratic system, and undermine the ability of ordinary people to choose their government.”

“The unelected judges of the Eighth Circuit rejected a Minnesota law modeled on the disclosure rules explicitly cited as constitutional in Citizens United, and thus today's decision takes a bad U.S. Supreme Court ruling and makes it worse. These courts have degraded our democracy by eliminating rules that provide accountability for politicians and sunlight for the political spending of the richest and most powerful people and organizations in the country.”
