ST. PAUL, MN – This afternoon, Legal Aid filed suit against Governor Tim Pawlenty challenging his recent unallotment of General Assistance Medical Care (GAMC) and the administration’s efforts to auto-enroll GAMC enrollees in MinnesotaCare. Legal Aid claims both actions are illegal and unconstitutional.
State Rep. Ryan Winkler (DFL Golden Valley) agrees. The following is a statement from Rep. Winkler supporting the lawsuit filed today.
-----------------------------------
"Using unallotment to kick poor people off health care is not only immoral, it’s illegal. Violating the law by shifting those individuals to MinnesotaCare is not only deceptive, it’s more expensive.
"Hard times do not give this administration or any Governor the unilateral authority to ignore the law.
"This legal challenge will help restore General Assistance Medical Care, which tens of thousands of poor, sick Minnesotans need. In the long-run, this lawsuit will also force the governor to follow the law and the constitution. That will restore legal protection for all Minnesotans."
