STATEMENT ON REPUBLICAN LAWSUIT


St. Paul, MN- Republican state legislators announced at a news conference today that they want Attorney General Lori Swanson to file a suit against the federal government. It is a response to the historic health insurance reform that Congress passed this weekend and President Obama signed into law today. State Rep. John Lesch has a response:

“With this pronouncement, we now know where the state Republican Party stands-and it’s not with Minnesotans. It is a complete waste of our time to be arguing in a court of law on whether Congress has the right to regulate commerce. It is clearly stipulated in the U.S. Constitution that Congress has all powers that are ‘necessary and proper’ when it comes to regulating interstate commerce.

I would like to ask my Republican colleagues if they think social security and medicare are unconstitutional federal programs. In my opinion, the new federal legislation is just an extension of these. If they want to come out in opposition to a program that bans insurance companies from denying coverage for pre-existing conditions and moves us toward a system where all citizens are covered, they can be my guest.

This tactic is pure politics. Republicans continue to be the party of no-nationally and in our state. While we take the lead on balancing our budget and capturing federal dollars for health care they waste time in courts with frivolous lawsuits."
