(St. Paul, MN) - State Representative David Dill and Senator Tom Bakk are encouraging property owners who lost buildings in the recent Ham Lake fire not to waste time in deciding their re-building plans.
According to Dill, property owners have 180 days to obtain a building permit to replace their destroyed structures, or their new building will fall under the current state building rules.
"With the change in state statutes, many of these original buildings are now considered to be non-conforming and would not permitted," said Dill. "However, if you obtain a building permit within 180 days, you will be allowed to build the same non-conforming structure that you had before, as long as the footprint doesn't change."
This 180-day deadline applies only to homestead and non-homestead residential real estate and seasonal residential real estate occupied for recreational purposes. Also, the board (County) may place some "reasonable conditions" on the permit to mitigate the impact on neighboring properties, according to Dill.
