Effect of Supreme Court Decision on Health Care


While most progressives are praising the Supreme Court decision as liberal because it upheld much of the Affordable Care Act, the result may actually be a sign of many anti-liberal decisions to come. The decision took a very conservative reading of the commerce clause which will restrict the federal government when it tries to protect consumers on issues such as foreclosures, faulty products, insurance and banking regulations to protect people, etc. While the decision upheld much of the law on the basis of taxing power, it also somewhat restricted the use of tax power to accomplish many of the goals of progressives.

Chief Justice Roberts is very conservative and very smart, and in this case, I think he saw a way to establish very conservative principles for the Court to follow in the future. He also invalidated part of the law, and left it up to states to decide on implementation.
