NEW JUDGE SUSPENDS FURTHER PROCEEDINGS ON NORTHERN METALS


Here is the latest Northern Metals update:

Northern Metals, without notice to the Pollution Control Agency, had gotten an court order that compelled the PCA to either order an Environmental Impact Statement (EIS) or issue their permit within 90 days. So, the PCA did a study and concluded that they should require an EIS. Thus, Northern Metals seemed to get what they wanted at the time of the first hearing. Then, Northern Metals realized that with an EIS there could be a study of environmental justice issues as well as issues of effects, financial, developmental, and environmental effects of possible future uses of the surrounding areas.

I assume Northern Metals realized the EIS was not going to be to their benefit. They went to a judge (the judge who issued the previous one recuse herself) and got the order terminated which they had asked for in the first place.

I have never seen such strange things happening in a court in my 30 plus years of practicing law. The order terminated the hearing today while we were part way through it. The PCA is ordered to do nothing until further order of the court.
