NORTHERN METAL RECYCLING SUES PCA OVER PERMIT POSTPONEMENT


I just talked to the PCA. A Judge in Ramsey County issued an Order to compel the PCA to hold a contested hearing. The Company's attorney used a special writ of mandamus, which is normally only issued in a situation needing fast action, when done without the other party at the hearing. The PCA wasn't even present at the hearing and say they were unaware of it.

I will know more next week. The Attorney General is looking into the unusual action by the Judge and the attorneys for Northern Metal. I'll let you know more when the AG and PCA get more information.

This certainly does not look to me like Northern Metal wants to be a good neighbor and work with the community. They seem very litigious, even more than their predecessor. Not a good indication.

As I informed you previously, at the time the City settled with their predecessor and paid them almost $9 million, I was told by city staff they got an agreement not to expand anything. However, all the city has been able to come up with for me in the two months since I asked for something about such an agreement is the settlement agreement document which contains very little and nothing about such an agreement not to expand. I hope the city has more than that.
