CHOICEPOINT AS AN INFORMATION BROKER PART OF A GROWING DATA AGGREGATION AND DATA MINING INDUSTRY LARGELY UNSEEN BY MINNESOTANS
Statement by State Representative Jim Davnie

"This industry is largely unknown and unseen and yet is a powerful force in people’s lives—impacting the interest rates they pay on auto, home equity, and home loans; credit card interest rates, and even their ability to secure jobs.
Identity theft has remained the #1 consumer fraud complaint for 5 years in a row to the Federal Trade Commission. The FTC estimates that this year 10 million Americans will become victims of identity theft. Incidents like this recent case with ChoicePoint Inc. show the vulnerability of Minnesotans to the breach of their privacy and risk of identity theft.
Minnesotans cannot avoid having their private data held in these databases and cannot opt out of these databases. They should have the right to be notified if the security of their most private financial data has been compromised. Consumers should expect prompt notification regarding an incident that could put them at risk and allow them to take the necessary steps to protect themselves from identity theft and a damaged credit rating.
While there is recently proposed legislation on the federal level, the federal wheels can move awfully slowly. Additionally, that legislation as currently proposed does not provide Minnesotans with as strongly a set of protections as this legislation would provide. I hope for strong bipartisan support and quick action on this bill."
