MINUTES
Representative Liebling, Chair of Committee on Health and Human Services Policy, called the meeting to order at 2:20 PM February 26, 2013 in Room 200 of the State Office Building.
The Committee Legislative Assistant noted the roll.

A quorum was not present.
Representative Atkins presented information relating to
HF459 (Atkins) Bisphenol-A children's food containers sale prohibited. Dr. David Wallingha gave background on chemicals in kids products and Bisphenol A (BPA).
At 2:26 PM a quorum was present.
Representative Ward moved to approve the minutes of February 20, 2013. Motion prevailed. The minutes were approved.
Chair Liebling moved that
HF459 be recommended to pass and re-referred to the Judiciary Committee.
The following individuals testified:
Diana Spurgeon, parent, testified in support of
HF459.
Tony Kwilas, MN Chamber of Commerce, testified that chemical regulation should be done at the federal level and addressed concerns.
Dr. Julie Goodman, Can Manufacturers Institute, testified in opposition of
HF459.
Chair Liebling allowed time for testimony from the public and questions from members and answers provided by Dr. Goodman and Tony Kwilas, MN Chamber of Commerce, Dr. Wallingha, and Representative Atkins.
Chair Liebling renewed her motion that
HF459 be recommended to pass and re-referred to the Judiciary Committee.
Chair Liebling moved that
HF458 (Persell) Formaldehyde banned in children's products, be recommended to pass and re-referred to the Judiciary Committee.
Chair Liebling moved that amendment H0458A1 of
HF458 be adopted. Motion prevailed.
Representative Persell presented information on
HF458.

HF458.
Andy Hackman, Toy Industry Association testified to
HF458 and
HF605 with language concerns.

Tony Kwilas, MN Chamber of Commerce, testified that chemical regulation should be done at the federal level and addressed concerns.
Chair Liebling allowed time testimony from the public and for member questions and answers provided by Representative Persell and Kathleen Schuler.
Chair Liebling renewed her motion that
HF458 be recommended to pass as amended and re-referred to the Judiciary Committee. Motion prevailed.
Chair Liebling moved that
HF605 (Winkler) Children protected from exposure to harmful chemicals in products, criteria amended for identification of priority chemicals, disclosure required by manufacturers of children's products that contain harmful chemicals, Pollution Control Agency authorized to prohibit sales of children's products that contain harmful chemicals, waiver process provided, and fees established, be recommended to pass and re-referred to the Judiciary Committee. Representative Winkler requested that
HF605 be re-referred to the Civil Law Committee and not the Judiciary Committee. Chair Liebling accepted request and moved that
HF605 be recommended to pass and re-referred to the Civil Law Committee.
Chair Liebling moved that amendment H0605DE1 be adopted. Motion prevailed. The amendment was adopted.
Chair Liebling allowed time for member questions and answers provided by Representative Winkler.

HF605 and provided clarification of amendment H0605DE1.
