1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. [5.38] AUTHORITY TO ACCEPT FUNDS.
1.4The secretary of state may solicit and accept funds from local governmental units to
1.5be used for technological projects to enhance the state's election system. In addition, the
1.6secretary of state may accept federal funds for election purposes. If the secretary of state
1.7accepts federal funds and the terms of the grant do not require the state to maintain its
1.8effort, section 3.3005 does not apply. If the secretary of state accepts federal funds and the
1.9terms of the grant do require the state to maintain its effort, section 3.3005 applies. The
1.10funds accepted under this section must be deposited in accounts in the special revenue fund
1.11and are appropriated to the secretary of state for the uses authorized by this section. The
1.12secretary of state shall report by January 15 each year to the chair and ranking minority
1.13members of the finance committees of the house of representatives and the senate with
1.14jurisdiction over the secretary of state the total amounts received in the preceding calendar
1.15year, the sources of those funds, and the uses to which those funds were or will be put.
1.16EFFECTIVE DATE.This section is effective the day following final enactment.

1.17    Sec. 2. [5B.12] AUTHORITY TO ACCEPT FUNDS.
1.18Notwithstanding sections 16A.013 to 16A.016, the secretary of state may accept
1.19funds contributed by individuals and may apply for grants from charitable foundations, to
1.20be used for the address confidentiality program established in section 5B.03. In addition,
1.21the secretary of state may apply for grants from the federal government for purposes of
1.22the address confidentiality program. If the secretary of state accepts federal funds and the
1.23terms of the grant do not require the state to maintain its effort, section 3.3005 does not
1.24apply. If the secretary of state accepts federal funds and the terms of the grant do require
1.25the state to maintain its effort, section 3.3005 applies. The funds accepted under this
2.1section must be deposited in accounts in the special revenue fund and are appropriated to
2.2the secretary of state for use in the address confidentiality program. The secretary of state
2.3shall report by January 15 each year to the chair and ranking minority members of the
2.4finance committees of the house of representatives and the senate with jurisdiction over
2.5the secretary of state the total amounts received in the preceding calendar year, the sources
2.6of those funds, and the uses to which those funds were or will be put.
