1.4    "Sec. 43. PERSISTENTLY LOWEST-ACHIEVING SCHOOL DESIGNATION;
1.5FEDERAL SCHOOL IMPROVEMENT GRANTS.
1.6For purposes of federal school improvement grants under the American Recovery
1.7and Reinvestment Act, and unless the chief administrator of a school voluntarily agrees to
1.8the designation in writing, the department must not use a school's high school graduation
1.9rate as a basis to designate a high school chartered under Minnesota Statutes, section
1.10124D.10, or an alternative learning program established under Minnesota Statutes, section
1.11123A.05, to serve and reengage students who were expelled, dropped out, or are otherwise
1.12not enrolled in school, among other students, as a persistently lowest-achieving school
1.13if on December 15 at least 70 percent of the students who, at the time they enroll in the
1.14school, are two or more years older than the average statewide age of other students
1.15enrolled in the same grade, lack a sufficient number of high school credits to graduate on
1.16time, or are otherwise eligible to participate in the graduation incentives program under
1.17Minnesota Statutes, section 124D.68.
1.18EFFECTIVE DATE.This section is effective the day following final enactment
1.19and applies retroactively to January 1, 2010."
