1.2Delete everything after the enacting clause and insert:

1.3    "Section 1. Minnesota Statutes 2006, section 246.0136, subdivision 1, is amended to
1.4read:
1.5    Subdivision 1. Planning for enterprise activities. The commissioner of human
1.6services is directed to study and make recommendations to the legislature on establishing,
1.7relocating, or closing enterprise activities within state-operated services. Before
1.8implementing, relocating, or closing an enterprise activity, the commissioner must obtain
1.9statutory authorization for its implementation, except that the commissioner has authority
1.10to implement enterprise activities for adult mental health, adolescent services, and to
1.11establish a public group practice without statutory authorization relocation, or closing.
1.12Enterprise activities are defined as the range of services, which are delivered by state
1.13employees, needed by people with disabilities and are fully funded by public or private
1.14third-party health insurance or other revenue sources available to clients that provide
1.15reimbursement for the services provided. Enterprise activities within state-operated
1.16services shall specialize in caring for vulnerable people for whom no other providers are
1.17available or for whom state-operated services may be the provider selected by the payer.
1.18In subsequent biennia after an enterprise activity is established within a state-operated
1.19service, the base state appropriation for that state-operated service shall be reduced
1.20proportionate to the size of the enterprise activity."
