2.9    (a) Notwithstanding other law or rule to the contrary, and in order to effectively

2.11children's education, a school district may apply to the commissioner for a waiver from
2.12the requirement to maintain racial balance within a district school if the racial imbalance
2.13in that school results from:
2.14    (1) the enrollment of protected multiracial students and the proportion of enrolled
2.15multiracial students reflects the proportion of multiracial students who reside in the school
2.16attendance area or who are enrolled in the grade levels served by the district; or
2.17    (2) the enrollment of limited English proficiency students in a transition program
2.18that includes an intensive English component.
2.19The commissioner must grant the waiver if the district in which the school is located offers
2.20the multiracial students or the limited English proficiency students, as appropriate, the
2.21option of enrolling in another school with the requisite racial balance, and the students'
2.22parents choose not to pursue that option.
2.23    (b) This section is effective for the 2006-2007 through 2010-2011 school years
2.24or until amended rules are adopted under Minnesota Statutes, chapter 3535, pertaining
2.25to racial diversity, whichever comes first.
2.26EFFECTIVE DATE.This section is effective the day following final enactment."

2.29    "Sec. 13. RULEMAKING AUTHORITY.
2.30    The commissioner of education shall adopt rules for implementing and administering
2.31the graduation-required assessment for diploma (GRAD) in reading and mathematics
2.32and in writing, consistent with Minnesota Statutes, section 120B.30, subdivision 1, and
2.33for public review of the GRAD test. The rules must specify the GRAD requirements
2.34that apply to students in unique circumstances including dual enrolled students, English
2.35language learners, foreign exchange students, home school students, open enrollment
3.1students, Minnesota postsecondary enrollment options students, shared-time students,
3.2transfer students from other states, and district-placed students and students attending
3.3school under a tuition agreement. The rules must establish the criteria for determining
3.4individualized GRAD passing scores for students with an individual education plan or
3.5a Section 504 plan and for using an alternative assessment when a student's individual
3.6education plan team decides to replace the GRAD test.
3.7EFFECTIVE DATE.This section is effective the day following final enactment.

3.8    Sec. 14. RULEMAKING REQUIRED.
3.9    (a) Notwithstanding the time limit in Minnesota Statutes, section 14.125, the state
3.10board of teaching must adopt the rules it was mandated to adopt under Laws 2003, chapter
3.11129, article 1, section 10. The board must publish a notice of intent to adopt rules or a
3.12notice of hearing for rules subject to this section before January 1, 2008.
3.13    (b) The failure of a board member to comply with paragraph (a) is a willful failure to
3.14perform a specific act that is a required part of the duties of a public official and is cause
3.15for removal under Minnesota Statutes, section 15.0575, subdivision 4.
3.16EFFECTIVE DATE.This section is effective the day following final enactment."

3.18    "(c) A school board must not charge a fee to a person serving in active military
3.19service under section 190.05, subdivision 5, who requests that the school district or
3.20charter school transmit a copy of the person's transcript to a postsecondary institution or
