MINUTES

Representative Carlson, Chair of the Ways and Means Committee, called the meeting to order at 11:05 A.M. on Tuesday, April 1, 2014, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Rep. Hornstein moved approval of the minutes of Monday, March 31, 2014. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Rep. Lenczewski moved that HF3167, First Engrossment, be recommended to be placed on the General Register.

Rep. Lenczewski moved to amend HF3167, First Engrossment. (See attached amendment H3167A4). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Davnie moved to amend HF3167, First Engrossment, as amended. (See attached amendment H3167A6). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Davnie moved to amend HF3167, First Engrossment, as amended, as follows:

Page 16, delete Section 7
Page 19, delete Section 8
Page 24, delete Section 9
Page 34, delete Section 13

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Lenczewski and Rep. Davnie presented HF3167, First Engrossment, as amended (Lenczewski) State financial management additional revenue priorities modified, and contingent transfers to the budget reserve provided.

Rep. Dettmer moved to amend HF3167, First Engrossment, as amended. (See attached amendment H3167A11).

Chair Carlson ruled Amendment H3167A11 was out of order because it would exceed the Budget Resolution under House Rule 4.03.


Rep. Dettmer moved to amend HF3167, First Engrossment, as amended. (See attached amendment H3167A10).

Rep. Lenczewski renewed the motion that HF3167, First Engrossment, as amended, be recommended to be place on the General Register. THE MOTION PREVAILED.

Chair Carlson moved that HF2446, Second Engrossment, be recommended to be place on the General Register.

Chair Carlson moved to amend HF2446, Second Engrossment. (See attached amendment H2446A3).

Rep. Simonson explained the proposed H2446A3 and H2446A5 amendments.

Bill Marx, Fiscal Analyst, responded to questions regarding the fiscal impact of the proposed H2446A3 and H2446A5 amendments.

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Chair Carlson moved to amend HF2446, Second Engrossment, as amended. (See attached amendment H2446A5). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Simonson presented HF2446, Second Engrossment, as amended (Simonson) Pharmacy Board cease and desist authority granted to prevent the sale of synthetic drugs, laws governing misbranding or adulterated drugs modified, drug definition expanded, emergency drug scheduling authority sunset and legislative reporting requirement repealed, mandatory restitution provided when a person is convicted for selling controlled substance under false pretenses, public education plan established, and money appropriated.

Chair Carlson renewed the motion that HF2446, Second Engrossment, as amended, be recommended to be place on the General Register. THE MOTION PREVAILED.

Chair Carlson moved that HF2576, Fourth Engrossment, be recommended to be placed on the General Register.

Chair Carlson moved to amend HF2576, Fourth Engrossment. (See attached amendment H2576A19). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Chair Carlson moved to amend HF2576, Fourth Engrossment, as amended. (See attached amendment H2576A21). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Melin presented HF2576, Fourth Engrossment, as amended (Melin) Criminal record expungement governing provisions modified, business screening services required to delete expunged records, and eviction record expungement allowed in some cases.

Bill Marx responded to the fiscal impact of HF2576, Fourth Engrossment, as amended.

Dana L. Goetz, Public Safety Department, responded to questions regarding HF2576, Fourth Engrossment, as amended.


Chair Carlson renewed the motion that HF2576, Fourth Engrossment, as amended, be recommended to be placed on the General Register. THE MOTION PREVAILED.

Rep. Davnie assumed chair at 12:04 P.M.

Rep. Carlson moved that HF3014, First Engrossment, be recommended to be placed on the General Register.

Rep. Carlson moved to amend HF3014, First Engrossment. (See attached amendment H3014A1). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Carlson presented HF3014, First Engrossment, as amended (Carlson) Public Employment Relations Board created, rulemaking authorized, and money appropriated.

Nicole Blissenbach, Attorney, Education Minnesota, responded to questions regarding HF3014, First Engrossment, as amended.

Rep. Carlson renewed the motion that HF3014, First Engrossment, as amended, be recommended to be placed on the General Register. THE MOTION PREVAILED.

Nancy Conley, Committee Administrator, announced the upcoming schedule of the Ways and Means Committee.
