MINUTES

Representative Liebling, Chair of Committee on Health and Human Services Policy, called the meeting to order at 2:18 PM February 6, 2013 in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present

Representative Ward moved to approve the January 30 and February 5 meeting minutes. Motion prevailed. The minutes were approved.

Continuation of testifiers of HF5

The following individuals testified:
Jonathan Watson, MN Association of Community Health Centers
Kelly Wolfe, Children's Hospital and Clinics
Todd Mikkelson, RM Group

Chair Liebling allowed time for questions and answers.

Representative Atkins and Exchange Director April Todd-Malmlov responded to questions from members regarding the exchange.

Chair Liebling moved HF5 be recommended to pass and be re-referred to the State Government Finance and Veterans Affairs committee.

Representative Atkins and April Todd-Malmlov responded to additional questions from members regarding the exchange.

Chair Liebling introduced amendment H0005A71.

The following individuals testified:
Peter Brickwedde, MN Department of Commerce
Representative Atkins and April Todd-Malmlov continue with clarifying information regarding the exchange.

Chair Liebling moved that amendment H0005A71 of HF5 be adopted. Motion prevailed. Amendment is adopted.

The Committee recessed at 3:43 PM.

The Committee reconvened at 8:32 PM.

Representative Loeffler introduced amendment H0005A85.

Representative Loeffler moved an oral amendment to amendment H0005A85 to delete "policy forms" on line 1.14 and insert "health benefit plans".

Kathryn Kmit, MN Council of Health Plans gave remarks regarding amendment H0005A85.

Chair Liebling allowed time for questions and answers regarding the amendment.

Representative Loeffler moved an oral amendment to eliminate section 7, lines 1.14 through 1.17 of amendment H0005A85. Chair Liebling moved to adopt amendment H0005A85 as amended. Motion prevailed. Amendment is adopted.

Chair Liebling allowed time for follow up questions regarding HF5.
Kathryn Kmit presented information regarding Gruber Gorman handout.

Representative Loeffler moved amendment H0005A84. Representative Loeffler moved an oral amendment to amend H0005A84 as follows:
Line 1.3, delete "suitability" and insert "affordability"
Line 1.15, delete "that only exchanged purchased" and insert "which group"

Peter Brickwedde gave remarks regarding the amendment. Following the discussion Representative Loeffler withdrew the H0005A84 amendment.

Chair Liebling moved amendment H0005A81.

Tim Wilkin, MN Association of Health Underwriters offered remarks regarding amendment H0005A81.

Chair Liebling moved an oral amendment to amend H0005A84 as follows:
Delete lines 1.5 though 1.8. Motion prevailed. Amendment is adopted as amended.

Representative Gruenhagen moved amendment H0005A63. Motion does not prevail. Amendment is not adopted.

Representative Mack moved amendment
H0005A77.
Jim Nobles, Legislative Auditor offered remarks regarding the amendment. Representative Atkins offered remarks regarding the amendment.

Representative Mack moved an oral amendment to amendment H0005A77 as follows:
Line 1.5, delete "as often" insert "less frequently". Chair Liebling moved to adopt amendment H0005A77 as amended. Motion prevailed. Amendment is adopted.

Representative Mack moved amendment H0005A70-1
Representative Atkins opposed the amendment.
April Todd-Malmlov and Kathryn Kmit offered remarks regarding the amendment.

Representative Mack renewed motion to adopt amendment H0005A70-1. Motion does not prevail. Amendment is not adopted.

Representative Schomacker introduced amendment H0005A75. Rep Schomacker requested a roll call vote. The results were as follows:

H0005A76. Motion does not prevail. Amendment is not adopted.

Representative Zerwas moved amendment H0005A78.
Representative Atkins opposed amendment. Motion does not prevail. Amendment is not adopted.

Representative Mack moved amendment H0005A82. Representative Atkins opposed amendment. Motion does not prevail. Amendment is not adopted.

Representative Mack moved amendment H0005A83. Representative Mack requested a roll call vote. Representative Mack moved an oral amendment to amendment H0005A83 as follows:
Add "Nothing in this provision shall prevent the Minnesota insurance marketplace from providing insurance for its employees."

Following discussion of the amendment Representative Mack withdrew request for a roll call. Representative Mack renews motion to adopt amendment H0005A83 as amended. Motion prevailed. Amendment is adopted.

Chair Liebling allowed time for questions and answers. Chair Liebling renews motion that HF5 be passed and be re-referred to the State Government Finance and Veterans Affairs committee. The motion prevailed.

The meeting was adjourned at 11:04 PM.
