Chair Thomas Huntley called to order the sixteenth meeting of the Health Care and Human Services Finance Committee at 9:10 a.m. in Room 10 of the State Office Building on Monday, February 18, 2013. A quorum was present. The committee legislative assistant noted the roll:

Representative Fritz moved approval of the February 14, 2013 minutes. The motion prevailed.

HF 5 (Atkins) - Minnesota Insurance Marketplace established, powers and duties prescribed, right to not participate established, open meeting requirements and data practices procedures specified, and money appropriated.

Representative Gruenhagen moved adoption of the H0005A122 amendment, and incorporated the removal of lines 1.9 through 1.11. The motion prevailed. The H0005A122 amendment was adopted, as amended.

Chair Huntley renewed his motion that HF 5, the fifth engrossment, be recommended to pass and be rereferred to the Committee on Taxes.

Representative Gruenhagen moved adoption of the H0005A123 amendment. Following discussion, Representative Gruenhagen withdrew the amendment.

Representative Liebling moved adoption of the H0005A130 amendment. The motion prevailed.

Representative Liebling moved adoption of the H0005A134-1
Representative Liebling moved adoption of the
H0005 A138 amendment, incorporating the following oral amendment:

Line 1.4, after "capacity" insert "or as a board member"

Following discussion, Representative Liebling withdrew her H0005A138 amendment, as amended.

Representative Liebling moved adoption of the H0005A140 amendment. Discussion occurred including testimony from Jeff Bartsch of Medica. Representative Liebling withdrew the H0005A140 amendment.

Chair Huntley moved adoption of the H0005A141 amendment. The motion prevailed.

Representative Abeler moved adoption of the H0005A164 amendment, incorporating an oral amendment to delete lines 1.3 through 1.5. He also noted his H0005A 174 amendment was similar but would not be offered. Discussion occurred, including testimony from Phil Griffin, Preferred One, for the Minnesota Council of Health Plans and April Todd-Malmlov, Exchange Director, and Kate Johanson of the Minnesota Chamber, who supported the amendment. Discussion continued and the motion prevailed. The H0005A164 amendment was adopted, as amended.

Representative Abeler moved adoption of the H0005A167 amendment. Following discussion, Representative Abeler withdrew the amendment.

Representative Abeler moved adoption of the H0005A168 amendment and incorporated the following oral amendment:

Line 1.2, after the comma, delete "delete subdivision 4 and"

The motion prevailed. The H0005A168 amendment was adopted, as amended.

Representative Abeler moved adoption of the H0005A169 amendment. Discussion occurred including testimony from April Todd-Malmlov. Representative Abeler withdrew the amendment.

Representative Abeler moved adoption of the H0005A171 amendment. Discussion occurred and Representative Abeler withdrew the amendment.

Representative Abeler moved adoption of the H0005A172 amendment. Following testimony from Kathryn Kmit, Minnesota Council of Health Plans, Representative Abeler withdrew the amendment.

Representative Abeler moved adoption of the H0005A173 amendment. Following discussion, Representative Abeler withdrew the amendment.

Representative Abeler moved adoption of the H0005A175 amendment. Following discussion, Representative Abeler withdrew the amendment.

Representative Mack moved adoption of the H0005A175 amendment and requested a roll call. Members voted as follows:

Ayes: Dean, Gruenhagen, Mack, McDonald, Schomacker, Zerwas
Nays: Huntley, Allen, Fischer, Fritz, Halverson, Hortman, Laine, Liebling, Loeffler, Moran, Newton
Pass: Norton, Abeler

There being 6 ayes , 12 nays, and 2 abstentions, the motion did not prevail. The amendment was not adopted.

Representative Loeffler moved adoption of the H0005A149 amendment. The motion prevailed.

Chair Huntley moved adoption of the H0005A150 amendment. The motion prevailed.

Chair Huntley moved adoption of the H0005A151 amendment. The motion prevailed.

Representative Laine moved adoption of the H0005A152 amendment, explained and then withdrew the amendment.

Representative Abeler moved adoption of the H0005A153 amendment. Following discussion, the motion prevailed.

Representative Liebling moved adoption of the H0005A155 amendment. Testimony from Dominic Sposeto, representing the Minnesota Federation of Insurance Agents. Following discussion, the motion prevailed.

Representative Loeffler moved adoption of the H0005A154 amendment. Discussion occurred and Representative Abeler moved dividing the amendment between lines 1.3 and 1.4 and incorporating the following:

Line 1.4, after "shall" delete "in any"
Line 1.5, delete "way"

The motion prevailed.

Discussion occurred regarding lines 1.1 to 1.3 including testimony from April Todd-Malmlov of the Exchange. Rep. Loeffler moved adoption of the H0005A154 amendment, incorporating the deletion of lines 1.2 and 1.3. The motion prevailed. The H0005A154 amendment, as amended, was adopted.

Representative Loeffler moved adoption of the H0005A156 amendment, incorporating an oral amendment to delete "may" on line 1.11. Discussion occurred including testimony from Tim Wilkin, Minnesota Association of Health Underwriters. Discussion continued. Representative Loeffler moved the following amendment to her H0005A156 amendment:

Line 1.15 After the period, insert "Nothing in this paragraph requires an individual to enroll in premium assistance or a MAGI public health program.-"

The motion prevailed. Representative Liebling called a division. There being 8 hands indicating ayes and 8 hands indicating nays, the motion did not prevail and the H0005A156 amendment, as amended, was not adopted.

The Chair announced the remaining amendments would be taken up the following morning during regularly scheduled committee time and adjourned the meeting at 11:53 a.m.
