MINUTES
Representative Denny McNamara, Chair of the Committee on Environment, Energy and Natural Resources Policy and Finance called the forty-sixth meeting to order at 8:20 a.m. on May 5, 2011, in Room 5 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present at 8:20 a.m.

H.F. 1303 (Garofalo) Revenue-based filing fee gradually adjusted beginning in fiscal year 2014.

Rep. McNamara moved that H.F. 1303, without recommendation, be passed and re-referred to the Committee on Ways and Means.

Rep. Garofalo presented H.F. 1303.

Brian Pietsch, Ameriprise Financial, Robyn Rowen, MN Insurance and Financial Services Council, testified on H.F. 1303.

Rep. McNamara renewed his motion that H.F. 1303, without recommendation, be passed and re-referred to the Committee on Ways and Means.

H.F. 1061 (Urdahl) Outdoor heritage fund, clean water fund, parks and trails fund, and arts and cultural heritage fund funding provided; outdoor heritage provisions modified; accounts established; Clean Water Legacy Act modified; Clean Water Council membership and duties revised; State Capitol Preservation Commission established; appointments provided; reporting and other requirements established for legacy fund recipients; and money appropriated.

Rep. McNamara moved that H.F. 1061 be recommended to pass and be re-referred to the Committee on Taxes.

Rep. Urdahl presented H.F. 1061.

Rep. Torkelson moved the H1061A36 amendment.

Rep. Torkelson moved to orally amend the H1061A36 amendment as follows:

Pg 1, line 4, after "receive" insert "up to".

THE MOTION PREVAILED. The amendment to the amendment was adopted.

Rep. Torkelson renewed his motion that the H1061A36 amendment as amended, be adopted. THE MOTION PREVAILED. The amendment was adopted.

Rep. McNamara moved the H1061A39 amendment.

Rep. Hansen requested a roll call vote.

Rep. McNamara laid H1061A39 on the table.

Rep. Hancock moved the H1061A46 amendment.

Forrest Bowe, MN Dept. of Natural Resources, testified on the H1061A46 amendment.

Rep. Wagenius moved to orally amend the H1061A46 amendment as follows:

Pg 1, line 9, after "entity" insert a period and delete "and the option to place a permanent conservation".

Delete line 1.10

Pg 1, line 11, delete everything before "the evaluation"

THE MOTION PREVAILED. The amendment to the amendment was adopted.

Rep. Hancock renewed his motion that the H1061A46 amendment, as amended, be adopted. THE MOTION PREVAILED. The amendment was adopted.

Rep. Drazkowski moved the H1061A49 amendment.

Pg 1, line 22, delete "16B.32" and delete "15B.32

THE MOTION PREVAILED. The amendment to the amendment was adopted.

Rep. Drazkowski renewed his motion that the H1061A49 amendment, as amended, be adopted. THE MOTION PREVAILED. The amendment was adopted.

Rep. Falk moved to orally amend the H.F. 1061 as follows:

Pg 11, line 7, after "access" insert "including public access to the capitol balcony".

THE MOTION PREVAILED. The amendment was adopted.

Rep. Wagenius moved the H1061A52 amendment. THE MOTION PREVAILED. The amendment was adopted.

Rep. Hansen moved the H1061A54 amendment and requested a roll call.

Dan Stoddard, MN Department of Agriculture, testified on the Hansen oral amendment.

Rep. Drazkowski requested a division on the voice vote. On a vote of 8 AYES and 6 NAYS THE MOTION PREVAILED. The amendment was adopted.

Rep. McNamara renewed his motion that H.F. 1061, as amended, be recommended to pass and be re-referred to the Committee on Taxes. The motion prevailed.

Representative Dill moved that the minutes from the committee meeting on May 3, 2011 be adopted. THE MOTION PREVAILED.
