MINUTES

Representative Hoppe, Chair of the Commerce and Regulatory Reform Committee, called the meeting to order at 2:33:20 p.m. on February 9, 2011, in the Basement Hearing Room of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Murdock moved to approve the minutes from February 2, 2011. The motion prevailed.

Chair Hoppe moved that SF0004-1 be recommended to pass and be placed upon the General Register.

Chair Hoppe moved delete all amendment S0004DE1, inserting HF9 language into SF0004-1. The motion prevailed. The amendment was adopted.

Representative Peppin introduced SF0004-1 as amended.

Annette Henkel from Minnesota Utility Investors testified.

Bride Seifert from Minnesota Chamber of Commerce testified.

Scott Gale from Minneapolis Building Construction Trades Council testified.

Sarah Mancell from PaR Nuclear and Women in Nuclear testified.

Dr. Mark Cooper from Institute of Energy and Economic Analysis at University of Vermont Law School testified.

Tom Casey from West Metro Global Warming Alliance testified.

David List testified.

Kristin Eide-Tollefson from Prairie Island Study Group testified.

Representative Anzelc moved amendment S0004A10.

Representative Davids moved an oral amendment to amend amendment S0004A10, striking words "of the following" on line 1.5, deleting "district" on line 1.6 and inserting "in that particular district," and deleting remaining wording after colon on line 1.6.

Representative Atkins requested a roll-call vote on the amendment to the amendment.

The following twenty members voted against the motion:

HOPPE, SANDERS, ATKINS, ANDERSON D., ANDERSON S., ANZELC, CRAWFORD, DAUDT, JOHNSON, KIEFFER, LILLIE, LOON, MAZOROL, MULLERY, MURDOCK, NELSON, O’DRISCOLL, SLOCUM, STENSRUD, TILLBERRY.

The following two members voted in favor of the motion:

DAVIDS, DITTRICH.

The motion did not prevail (2-20). The oral amendment to the amendment was not adopted.

Representative Atkins requested a roll call vote on amendment S0004A10. The motion did not prevail. The amendment S0004A10 was not adopted (9-13).

The following thirteen members voted against the motion:

HOPPE, SANDERS, ANDERSON D., ANDERSON S., CRAWFORD, DAUDT, DAVIDS, KIEFFER, LOON, MAZOROL, MURDOCK, O’DRISCOLL, STENSRUD.

The following nine members voted in favor of the motion:

ATKINS, ANZELC, DITTRICH, JOHNSON, LILLIE, MULLERY, NELSON, SLOCUM, TILLBERRY.

Representative Slocum moved amendment S0004A8.

Representative Atkins requested a roll call vote.

The following thirteen members voted against the motion:

HOPPE, SANDERS, ANDERSON D., ANDERSON S., CRAWFROD, DAUDT, DAVIDS, KIEFFER, LOON, MAZOROL, MURDOCK, O’DRISCOLL, STENSRUD.

The following nine members voted in favor of the motion:

ATKINS, ANZELC, DITTRICH, JOHNSON, LILLIE, MULLERY, NELSON, SLOCUM, TILLBERRY.

The motion did not prevail (9-13). The amendment S0004A8 was not adopted.

Representative Atkins moved amendment S0004A13.

Terry Pitkens, Director of nuclear regulatory policy for Excel Energy testified.

Representative Atkins requested a roll call vote.

The following thirteen members voted against the motion:

HOPPE, SANDERS, ANDERSON D., ANDERSON S., CRAWFORD, DAUDT, DAVIDS, KIEFFER, LOON, MAZOROL, MURDOCK, O’DRISCOLL, STENSRUD.

The following nine members voted in favor of the motion:

ATKINS, ANZELC, DITTRICH, JOHNSON, LILLIE, MULLERY, NELSON, SLOCUM, TILLBERRY.

The motion did not prevail (9-13). The amendment S0004A13 was not adopted.

Representative Nelson moved amendment S0004A14 and requested a roll call vote.

The following thirteen members voted against the motion:

HOPPE, SANDERS, ANDERSON D., ANDERSON S., CRAWFORD, DAUDT, DAVIDS, KIEFFER, LOON, MAZOROL, MURDOCK, O’DRISCOLL, STENSRUD.

The following nine members voted in favor of the motion:

ATKINS, ANZELC, DITTRICH, JOHNSON, LILLIE, MULLERY, NELSON, SLOCUM, TILLBERRY.

The motion did not prevail (9-13) The mendment S0004A14 was not adopted.

Representative Atkins moved amendment S0004A12 and requested a roll call vote.

The following thirteen members voted against the motion:

HOPPE, SANDERS, ANDERSON D., ANDERSON S., CRAWFORD, DAUDT, DAVIDS, KIEFFER, LOON, MAZOROL, MURDOCK, O’DRISCOLL, STENSRUD.

The following nine members voted in favor of the motion:

ATKINS, ANZELC, DITTRICH, JOHNSON, LILLIE, MULLERY, NELSON, SLOCUM, TILLBERRY.

The motion did not prevail (9-13). The amendment S0004A14 was not adopted.

Hoppe moved that SF004-1 as amended be recommended to pass and be placed upon the General Register. Representative Sarah Anderson requested a roll call vote.

The following six members voted against the motion:

ANZELC, JOHNSON, LILIE, MULLERY, SLOCUM, TILLBERRY.

The following sixteen members voted in favor of the motion:

HOPPE, SANDERS, ATKINS, ANDERSON D., ANDERSON S., CRAWFORD, DAUDT, DAVIDS, DITTRICH, KIEFFER, LOON, MAZOROL, MURDOCK, NELSON, O’DRISCOLL, STENSRUD.

Representative Hoppe’s motion prevailed (16-6).

The meeting was adjourned at 4:01:11.
