MINUTES


Debra Hilstrom, Chair of the Public Safety Policy & Oversight Committee, started the thirtieth meeting of the House Public Safety Policy & Oversight Committee at 1:02 pm on Thursday, February 25, 2010 in room 10 of the of the State Office Building.

The Committee Legislative Assistant noted the roll.

HF3038 (Olin): Inmate payment of room and board modified to include any time credited for time served.

Rep. Olin presented HF3038, and took questions from the committee.

The following individuals testified in support of HF3038 and took questions from the committee:

John Tuma, Minnesota Inter-County Association

A quorum was present at 1:10pm and the committee was officially called to order.

Rep. Olin moved that HF3038 be recommended to pass and be placed on the General Register.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

Vice- Chair Bigham assumed the gavel at 1:13pm.

HF2991 (Hilstrom): Court authorized to furnish any electronic copies of documents to public defender at no charge.

Rep. Hilstrom moved that HF2991 be laid over for possible inclusion in the Public Safety Policy & Omnibus Bill.

Rep. Hilstrom presented HF2991 and took questions from the committee.

Bob Sykora, Minnesota Public Defenders, testified in support of HF2991 and took questions from the committee.

John Kingrey, Minnesota County Attorneys Association, testified on HF2991 and took questions from the committee.

Rep. Hilstrom renewed her motion that HF2991 be laid over for possible inclusion in the Public Safety Policy & Omnibus Bill.
Vice-Chair Bigham laid HF2991 over for possible inclusion in the Public Safety Policy & Omnibus Bill.

Chair Hilstrom resumed the gavel at 1:28 pm.

HF3018 (Paymar): Prostitution law provisions clarified and recodified and certain definitions modified.

Rep. Lesch moved that HF3018 be recommended to pass and be placed on the General Register.

Rep. Lesch presented HF3018 on behalf of Rep. Paymar, and took questions from the committee.

Mary Ellison, Advocates for Human Rights, testified in support of HF3018 and took questions from the committee.

Rep. Lesch renewed his motion that HF3018 be recommended to pass and be placed on the General Register.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF1217 2nd Engrossment (Gardner): Drug producers required to register and pay a fee, drug collection program funded by drug producers, reports required, account created, penalties provided, categories expanded of persons allowed to possess legend and nonprescription drugs to include those disposing of them, definitions modified, flushing drugs prohibited by health care facilities, and money appropriated.

Chair Hilstrom moved that HF1217 En. 2 be recommended to pass and be re-referred to the Committee on Civil Justice.

Chair Hilstrom moved to amend HF1217 En. 2 (see H1217A7).

Rep. Gardner offered an oral amendment to the H1217A7 amendment as follows:

Page 1, line 9: delete "12" and insert "9"
Page 1, line 9: after "after" and before "a" insert "the second"
Page 1, line 10: after "law" insert "or to a"

Chair Hilstrom incorporated the changes into the H1217A7 amendment.

Chair Hilstrom renewed her motion to amend HF1217 En. 2, (see H1217A7, as incorporated),
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Gardner presented HF1217 En. 2 as amended, and took questions from the committee.

Chair Hilstrom renewed her motion that HF1217 En. 2 be recommended to pass and be re-referred to the Committee on Civil Justice.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

Rep. Lesch moved to adopt the Crime Victims/Criminal Records Division Reports on HF2608 and HF2864.

Rep. Lesch presented the Division Reports and took questions from the committee.

Rep. Lesch renewed his motion to adopt the Crime Victims/Criminal Records Division Reports on HF2608 and HF2864.
THE MOTION PREVAILED AND THE REPORT WAS ADOPTED.

HF2864 Committee Engrossment 1 (Gardner): Domestic abuse offenders electronic monitoring pilot project authorized.

Chair Hilstrom moved that HF2864 CE 1 be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Public Safety Finance Division.

Chair Hilstrom moved to amend HF2864 CE1 (see H2864DE1).
THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Rep. Gardner presented HF2864 CE 1 and took questions from the committee.

Chair Hilstrom renewed her motion that HF2864 CE 1, as amended, be recommended to pass and be re-referred to the Committee on Finance with a recommended re-referral to the Public Safety Finance Division.
THE MOTION PREVAILED AND THE BILL WAS PASSED.

HF2608 (Hilstrom): Protection area extended to a reasonable area around residence or dwelling in ex parte orders for protection.
Chair Hilstrom moved that HF2608 be recommended to pass and be placed on the General Register.

Chair Hilstrom presented HF2608 and took questions from the committee.

Rep. Lesch moved to adopt the minutes of Feb. 18, 2010.
THE MOTION PREVAILED. THE MINUTES WERE ADOPTED.
