MINUTES


Representative Gene Pelowski, Chair of the State & Local Government Operations, Reform, Technology and Elections Committee, called the meeting to order at 8:30 A.M. on Tuesday, March 16, 2010, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Poppe moved that the minutes of March 11, 2010 be approved. THE MOTION PREVAILED.

Chairman Pelowski moved that HF3389 be recommended to pass and re-referred to the Committee on Finance.

Chairman Pelowski moved to amend HF3389 (see attached H3389A1). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Mahoney presented HF3389 (Mahoney), as amended, a bill for an act relating to economic development; creating the Minnesota Science and Technology Authority; etc.

Chairman Pelowski renewed the motion that HF3389, as amended, be recommended to pass and re-referred to the Committee on Finance. THE MOTION PREVAILED.

Chairman Pelowski moved that HF3106, First Engrossment, be recommended to pass and re-referred to the Committee on Civil Justice.

Chairman Pelowski moved to amend HF3106, First Engrossment (see attached H3106A14).

Representative Sailer presented HF3124 (Dill), First Engrossment, a bill for an act relating to game and fish; modifying aquaculture provisions; modifying provisions for taking, possessing, and transporting wild animals; modifying requirements for fish and wildlife management plans; etc.

Chairman Pelowski renewed the motion that HF3124, First Engrossment, be recommended to pass and re-referred to the Committee on Finance. THE MOTION PREVAILED.

Continuation of HF3475 (Dittrich):

Chairman Pelowski moved that HF3475 be recommended to pass and re-referred to the Committee on Environment Policy and Oversight.

Chairman Pelowski moved to amend HF3475 (see attached H3475DE1).

Chairman Pelowski moved to incorporate an amendment to amendment H3475DE1 as follows:

Page 7, line 1, after "members" insert "appointed"

THE MOTION PREVAILED. THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Representative Dittrich presented HF3475 (Dittrich), as amended, a bill for an act relating to education; creating an independent agency to oversee the management of Minnesota’s permanent school fund lands; etc.

Representative Kalin moved to amend HF3475 as amended (amending amendment H3475DE1 previously adopted) as follows:

Page 7, line 14, after "serves" insert "a six-year term, but may be removed"

Representative Hornstein moved that HF1828 be recommended to pass and sent to the General Register.

Representative Buesgens moved to amend HF1828 as follows:

Page 1, line 14 through Page 2, line 2, delete the new language

THE MOTION FAILED. THE AMENDMENT WAS NOT ADOPTED.

Representative Hornstein presented HF1828 (Hornstein), a bill for an act relating to municipal planning; authorizing amendments to a municipal comprehensive plan for affordable housing to be approved by a simple majority; etc.

Representative Hornstein renewed the motion that HF1828 be recommended to pass and sent to the General Register. THE MOTION PREVAILED.

Chairman Pelowski moved that HF2660 be recommended to pass and re-referred to the Committee on Finance.

Representative Thissen presented HF2660 (Thissen), a bill for an act relating to state government; creating the Minnesota Coalition for Innovation and Collaboration; providing for certain rule and law waivers; etc.

Chairman Pelowski moved to amend HF3055, First Engrossment (see attached H3055A2).

Chairman Pelowski moved to incorporate an amendment to amendment H3055A2 as follows:

Page 1, line 8, delete "area" and insert "authority"

Page 1, line 11, after "for" insert "a"

Representative Thissen presented HF3055 (Thissen), First Engrossment, as amended, a bill for an act relating to human services; making changes to the State-County Results, Accountability, and Service Delivery Redesign Act; specifying public employee status for service delivery units; etc.

Chairman Pelowski moved that HF2510 be recommended to pass and sent to the General Register.

Chairman Pelowski moved to amend HF2510 (see attached A10-2311). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Gardner presented HF2510 (Gardner), as amended, a bill for an act relating to elections; prohibiting threats of reprisal against a person who is or is considering being a candidate; etc.

Chairman Pelowski renewed the motion that HF2510, as amended, be recommended to pass and sent to the General Register. THE MOTION PREVAILED.

Chairman Pelowski moved that HF1531 be recommended to pass and re-furred to the Committee on Civil Justice.

Chairman Pelowski moved to amend HF1531 (see attached H1531A3). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Loeffler presented HF1531 (Loeffler), a bill for an act relating to state government; providing additional whistleblower protection to state employees; etc.

Chairman Pelowski renewed the motion that HF1531, as amended, be recommended to pass and re-referred to the Committee on Civil Justice. THE MOTION PREVAILED.
