Representative Swails, Vice Chair of the Transportation and Transit Policy and Oversight Division, called the meeting to order at 4:38 P.M. on Tuesday, March 24, 2009 in Room 10 of the State Office Building. The Committee Legislative Assistant noted the roll.

Representative Torkelson moved the minutes of March 23, 2009, THE MOTION PREVAILED.

HF1435 (Knuth) Noise abatement requirements on highway construction projects modified. Stan Harpstead, Mayor of Arden Hills, spoke in favor of the bill. Frank Pafko, Office of Environmental Services MnDOT, spoke against the bill. A fiscal note was not yet available on the bill. Rep. Swails moved that HF1435 be rereferred to the Transportation Finance Division. THE MOTION PREVAILED.

HF1074 (Abeler) Anoka County; Design-build process authorized to award contract for construction of intersection of U.S. Highway 10 and County State-Aid Highway 83. Doug Fischer, Anoka County Engineer and Bob Ramsey, Mayor of Ramsey, spoke in support of the bill. Rep. Swails moved the H1074DE2 delete everything amendment. THE MOTION PREVAILED. Tim Worke, Highway Division Director, General Contractors, spoke to the bill. Rep. Masin moved the H1074A2 amendment. THE MOTION PREVAILED.
Rep. Morrow moved the H1047A1 amendment. Eric Rudeen spoke in opposition to the amendment. Rep. Morrow withdrew the H1047A1 amendment. HF1074 was laid over for possible inclusion in the Omnibus Transportation Policy bill.

HF572 (Haws) Veteran status designation provided on drivers' licenses and Minnesota identification cards. Lt. Col. Barb O’Reilly and Christine Kiel, Department of Veterans Affairs, spoke to the bill. Rep. Swails moved adoption of the author’s verbal amendment:

On page 3, delete lines 3, 4, 5 and 6

THE MOTION PREVAILED. Rep. Swails moved that HF572, as amended, be rereferred to the Transportation Finance Division. THE MOTION PREVAILED.

HF1672 (Davnie) Intersection gridlock prohibited, petty misdemeanor penalty imposed. Rep. Swails moved HF1672 before the committee. Rep. Swails moved the A09-0177 amendment. THE MOTION PREVAILED. The following spoke to the bill:

HF1672, as amended, was laid over for possible inclusion in the Omnibus Transportation Policy bill.

HF836 (Drazkowski) Town road speed limits modified. Hal Becker, Wabasha resident spoke to the bill. HF836 was laid over for possible inclusion in the Omnibus Transportation Policy bill..

HF1421 (Scott) Speed limit provisions amended. Rep. Scott moved the H1421A1 amendment with the following verbal amendment:

On line 1.3 delete delete and insert: strike
On line 1.5 delete delete and insert: strike
THE MOTION PREVAILED. Bernie Arseneau, Director of Policy, Safety & Strategic Initiatives and Dave Berkowitz, Andover City Engineer spoke to the bill. HF1421, as amended, was laid over for possible inclusion in the Transportation Policy Division Omnibus bill.

HF1209 (Demmer) Corporate deputy registrar expiration date removed. Jim Hirst, MN Deputy Registrar’s Association and Linda Marti, Deputy Registrar, Kasson, MN, spoke in favor of the bill. Rep. Swails moved that HF1209 be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

HF1192 (Brod) New Prague; Trunk Highway 19 closure required for the Dozinky Festival. The following spoke to the bill:

Mark Vosejpka, New Prague Police Chief
Scott Peterson, MnDOT
Mike Johnson, City Administrator, New Prague

Rep. Swails moved that HF1192 be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

HF1490 (Davnie) Motor carriers of railroad employees regulated. Rep. Swails moved adoption of the A09-0265
HF1204 (Dean) Stillwater Lift Bridge weight limits restricted. Rep. Swails moved the
H1204DE1 amendment. THE MOTION PREVAILED. Rep. Hausman moved to verbally amend the H1204DE1 amendment as follows:

Page 1, line 8, delete ‘arrange with" and insert ‘request that"
Page 1, line 9, delete "for the posting of" and insert "post"

THE MOTION PREVAILED. Jim Rousch, Stillwater City Councilmember, Dan Dorgan, Bridge Engineer, MnDOT and John Gannaway, Chief of Police in Stillwater spoke to the bill. Amber Backhaus, MN Trucking Association, shared some concerns with the bill. Rep. Swails moved that HF1204, as amended, be rereferred to the Commerce Committee. THE MOTION PREVAILED.

At 7:36 Rep. Hornstein took the gavel.
