MINUTES


Representative Kahn, Chair of the Division, called the meeting to order at 10:38 A.M. on March 24, 2010 in Room 300 North of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was not present.

HF 1818 (Mariani) State commissioners required to provide a poverty impact statement on bills when requested by a legislator.

A quorum was present at 10:40 A.M.

Chair Kahn moved that HF 1818 be recommended to pass and be re-referred to the Finance Committee.

Vice-Chair Winkler moved that the minutes of March 16, 2010, March 18, 2010 and March 23, 2010 be adopted. THE MOTION PREVAILED.

Representative Mariani testified in support of HF 1818.

Chair Kahn moved the H1818DE2 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Tom Gillaspy, State Demographer, responded to member questions.

Chair Kahn renewed her motion that HF 1818 be recommended to pass, as amended, and be re-referred to the Finance Committee. THE MOTION PREVAILED.

HF 2755 (Swails) Voting equipment and vote-counting equipment grant funding provided, grant terms and procedures specified, and money appropriated.

Chair Kahn moved that HF 2755 be recommended to pass and be re-referred to the Finance Committee.


Chair Kahn moved the SCS2629A-2 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Kevin Corbid, Director, Washington County Property Records and Taxpayer Services Department, testified in support of HF 2755.

Chair Kahn renewed her motion that HF 2755 be recommended to pass, as amended, and be re-referred to the Finance Committee. THE MOTION PREVAILED.

HF 2509 (Kahn) General fund matching appropriations transfer to the Help America Vote Act account provided.

Chair Kahn moved that HF 2509 be recommended to pass and be re-referred to the Finance Committee.

Chair Kahn moved the H2509A1 amendment. THE MOTION PREVAILED AND THE AMENDMENT WAS ADOPTED.

Beth Fraser, Director of Governmental Affairs, Office of the Secretary of State, testified in support of HF 2509.

Chair Kahn renewed her motion that HF 2509 be recommended to pass, as amended, and be re-referred to the Finance Committee. THE MOTION PREVAILED.

HF 3258 (Beard) Funds established in the constitution provided to pay for audit costs incurred by the legislative auditor, and money appropriated.

Representative Holberg moved that HF 3258 be recommended to pass and be re-referred to the Finance Committee.

Representative Holberg testified in support of HF 3258 and then moved the H3258A1 amendment. She then incorporated the following oral amendment to the H3258A1 amendment:

Page 1, line 5, after "auditor" insert "and the funds established in the Minnesota Constitution Article XI, Section 15"

THE MOTION PREVAILED AND AMENDMENT, AS AMENDED WAS ADOPTED.

Jim Nobles, Legislative Auditor, responded to member questions.

Representative Holberg renewed her motion that HF 3258 be recommended to pass, as amended, and be re-referred to the Finance Committee. THE MOTION PREVAILED.

HF 2754 (Winkler) Secretary of state filings regulated.

Vice-Chair Winkler moved that HF 2754 be recommended to pass and be re-referred to the Finance Committee.

Bert Black, Legal Advisor, Office of the Secretary of State, responded to member questions.

Vice-Chair Winkler renewed his motion that HF 2754 be recommended to pass and be re-referred to the Finance Committee. THE MOTION PREVAILED.

HF 2557 (Kahn) State Webmaster position established, and state chief information officer required to develop standards for enhanced public access to state electronic records.

Chair Kahn moved that HF 2557 be recommended to pass and be re-referred to the Finance Committee.

Michael Muilenburg, Legislative Director, and Larry Freund, Chief Financial Officer, both from the Office of Enterprise Technology, responded to member questions.

Chair Kahn moved the following oral amendment:

Page 1, line 20, delete "shall" and insert "may"
Page 1, line 21, delete "including,"
Page 1, line 22, delete "but not limited to, Web sites maintained under section 16E.07"
Page 1, line 25, after "Webmaster" insert "if appointed"

THE MOTION PREVAILED AND THE ORAL AMENDMENT WAS ADOPTED.

Representative Holberg moved an oral amendment to HF 2557 as follows:

Page 3, line 17, after "officer" insert "in consultation with the Information Policy Analysis Division of the Department of Administration"

THE MOTION PREVAILED AND THE ORAL AMENDMENT WAS ADOPTED.

Chair Kahn renewed her motion that HF 2557 be recommended to pass, as amended, and be re-referred to the Finance Committee. THE MOTION PREVAILED.

HF 3589 (Kath) Contracts for professional or technical services reporting threshold reduced.

Representative Kath moved that HF 3589 be recommended to pass and be re-referred to the Finance Committee and gave a brief overview of the bill.

Lenora Madigan, Director, and Justin Kaufman, Attorney, both from the Department of Administration, explained their concerns with parts of the bill.

Chair Kahn indicated there was a need for more discussion and the bill was laid over until the next meeting.

The meeting was adjourned at 11:56 A.M.
