MINUTES


Representative Tom Rukavina, Chair of the Higher Education and Workforce Development Finance and Policy Division, called the meeting to order at 8:30 A.M. on Tuesday, March 23, 2010, in Room 500S of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

HF 3293 (Clark)

When a quorum is present, Representative Clark moved that HF 3293 be recommended to pass and be referred to the Finance Committee.

When a quorum is present, Representative Clark moved to amend HF 3293 with the delete everything amendment A10-2410, attached.

Representative Clark presented HF 3293 as amended, relating to residential construction; amending the State Building Code; modifying licensing requirements.

Dan Newman, Executive Director, Sustainable Resources Center, introduced himself and provided testimony regarding HF 3293.

Questions and discussion followed.

Chair Rukavina noted that when a quorum is present, the committee would act on Representative Clark’s motions.

HF 3024 (Murdock)

When a quorum is present, Representative McFarlane moved that HF 33024 be recommended to pass and be referred to the Finance Committee.

Representative Murdock presented HF 3024, relating to labor and industry; modifying the requirements of the Manufactured Home Building Code.

Questions and discussion followed.

Chair Rukavina noted that when a quorum is present, the committee would act on Representative McFarlane’s motion.

HF 3076 (Juhnke)

Representative Poppe moved that HF 3076 be recommended to pass and be referred to the Finance Committee.

Representative Juhnke presented HF 3076, relating to labor and industry; modifying elevator provisions.

Questions and discussion followed.

A quorum was now present.

Representative Poppe renewed her motion that HF 3076 be recommended to pass and be referred to the Finance Committee. THE MOTION PREVAILED.

Representative Clark renewed her motion that HF 3293 be recommended to pass and be referred to the Finance Committee.

Representative Clark moved to amend the delete everything amendment A10-2410 as follows:

Page 1, line 18, delete "have provided" and insert "be able to provide"

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Clark moved to amend HF 3293 with the delete everything amendment A10-2410 as amended. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Clark renewed her motion that HF 3293 be recommended to pass and be referred to the Finance Committee. THE MOTION PREVAILED.

Representative McFarlane renewed her motion that HF 33024 be recommended to pass and be referred to the Finance Committee. THE MOTION PREVAILED.

HF 3533 (Rukavina)

Representative Rukavina moved that HF 3533 be recommended to pass and be referred to the General Register.

Representative Rukavina moved to amend HF 3533 with the amendment A10-2417. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Representative Rukavina presented HF 3533, relating to employment; providing that certain joint powers agreements may not circumvent or impinge upon the rights of employees covered by certain collective bargaining agreements.

Keith Carlson, Minnesota Inter County Association, introduced himself and provided testimony regarding HF 3533.

Representative Rukavina moved that HF 3533 be held over for possible inclusion.

HF 3386 (Swails)

For an informational hearing only, Representative Swails presented HF 3386, relating to real property; requiring performance guidelines for certain residential contracts; modifying statutory warranties; requiring notice and opportunity to repair; providing for dispute resolution procedures; requiring a report.

Questions and discussion followed.

Representative Nornes moved that the minutes of March 9, March 10, March 11, March 16 and March 18, 2010 be adopted. THE MOTION PREVAILED.

Charlie Durenberger, Minnesota Department of Labor and Industry, introduced himself and provided testimony regarding HF 3386.

Questions and discussion followed.

Chair Rukavina made announcements.
