Representative Carlson, Chair of the Finance Committee, called the meeting to order at
8:32 A.M. on Wednesday, April 7, 2010, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Chair Carlson moved adoption the Higher Education and Workforce Development Policy and Finance Division Report for HF3127, First Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Chair Carlson moved that HF 3127, First Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Davnie presented HF3127, First Engrossment (Davnie) Administrative, benefit, and tax provisions modified.

Lee Nelson, Attorney, Unemployment Insurance Legal Affairs, Minnesota Department of Employment and Economic Development, (DEED), responded to questions regarding HF3127, First Engrossment.

Rep. Obermueller presented SF3123, First Engrossment (Obermueller) Benefit account requirements modified for unemployment benefits.

Chair Carlson moved to amend HF3127, First Engrossment. (See attached amendment
A10-2474). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Chair Carlson renewed the motion that HF3127, First Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Winkler moved approval of the minutes of Friday, March 26, 2010. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Chair Carlson moved adoption the Higher Education and Workforce Development Policy and Finance Division Report for HF3076, First Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Juhnke moved that SF2844, First Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.


Rep. Juhnke presented SF2844, First Engrossment (Juhnke) Elevator provisions modified.

Rep. Champion moved adoption of the Transportation Finance and Policy Division Report for HF3524, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Lieder presented HF3524, First Committee Engrossment (Lieder) Authorization and discontinuance of special plates governing provisions modified.

Chair Carlson moved that HF3386, Second Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Chair Carlson moved to amend HF3386, Second Engrossment. (See attached amendment H3386A1). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Swails presented HF3386, Second Engrossment, as amended (Swails) Residential contracts performance guidelines required, statutory warranties modified, notice and opportunity to repair required, and dispute resolution procedures provided.

Charlie Durenberger, Director of Residential Licensing, Minnesota Department of Labor and Industry, (DOLI) testified on HF3386, Second Engrossment, as amended.

Rep. Obermueller responded to questions regarding HF3386, Second Engrossment, as amended.

Chair Carlson renewed the motion that HF3386, Second Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Kahn moved adoption of the State Government Finance Division Report for HF3310, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Kahn moved that HF3310, First Committee Engrossment be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Kahn moved to amend HF3310, First Committee Engrossment. (See attached amendment H3310A1). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Hilstrom presented HF3310, First Committee Engrossment, as amended (Hilstrom) State Patrol tax compliance and vehicle crimes investigations funding provided, and money appropriated.

Rep. Kahn renewed the motion that HF3310, First Committee Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Paymar moved that HF2470, First Engrossment be recommended to pass and placed on the General Register.

Rep. Hilstrom presented HF2470, First Engrossment (Hilstrom) Scanning device and re-encoder use to acquire information from payment cards included as identity theft.

Rep. Paymar renewed the motion that HF2470, First Engrossment be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

Rep. Solberg moved adoption of the Higher Education and Workforce Development Policy and Finance Division Report for HF3024, First Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Solberg moved that HF3024, First Engrossment be recommended to pass and placed on the General Register.

Rep. Solberg moved to amend HF3024, First Engrossment. (See attached amendment H3024A3). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Murdock presented HF3024, First Engrossment, as amended (Murdock) Manufactured Home Building Code requirements modified.

Rep. Solberg renewed the motion that HF3024, First Engrossment, as amended, be recommended to pass and placed on the General Register. THE MOTION PREVAILED.

Rep. Greiling moved adoption of the K-12 Education Finance Division report for HF2887, First Committee Engrossment. THE MOTION PREVAILED. THE DIVISION REPORT WAS ADOPTED.

Rep. Greiling moved that HF2887, First Committee Engrossment be recommended to pass and re-referred to the Committee on Taxes.

Bill Marx, Chief Fiscal Analyst, responded to questions regarding HF2887, First Committee Engrossment.

Rep. Smith and Rep. Buesgens presented HF2887, First Committee Engrossment (Drazkowski) Independent School District No. 858, St. Charles, disaster aid funding and declining pupil unit aid appropriation used to help the city cover revenue losses.

Rep. Drazkowski presented HF2887, First Committee Engrossment (Drazkowski) Independent School District No. 858, St. Charles, disaster aid funding and declining pupil unit aid appropriation used to help the city cover revenue losses.

Rep. Solberg renewed the motion that HF2887, First Committee Engrossment, be re-referred to the Committee on Taxes without further recommendation. THE MOTION PREVAILED.
