MINUTES


Representative Lesch, Chair, began the meeting at 10:05 A.M. on Friday, February, 15, 2008, in Room 300S of the State Office Building. A quorum was not present.

HF 2991 (Simon): A bill for an act relating to data practices; modifying provisions of the safe at home program; amending Minnesota Statutes 2006, sections 5B.02; 5B.03, subdivision 1; 5B.07; 171.06, subdivision 3; 171.07, subdivisions 1, 3.

Representative Kalin moved HF 2991 before the committee.

Representative Simon presented his bill.

Noting the presence of a quorum, discussion on HF 2991 was temporarily suspended while Representative Lesch, Chair, officially called the meeting to order at 10:12 A.M.

Representative Kalin moved approval of the Minutes for March 16, 2007. THE MOTION PREVAILED AND THE MINUTES WERE APPROVED.

Reverting to the discussion of HF 2991, Representative Kalin moved to orally amend the DE1 amendment as follows:

Page 1, line 1.23, after "they" insert:

"are clearly defined pharmaceuticals or"

Page 1, line 1.24, delete everything after the first period.

THE MOTION PREVAILED.

Representative Kalin moved adoption of the DE1 amendment as amended. THE MOTION PREVAILED.

Representative Kalin moved that HF 2991, as amended, be recommended to pass and be re-referred to the Public Safety and Civil Justice Policy Committee. THE MOTION PREVAILED.

HF 1625 (Hosch): A bill for an act relating to public safety; authorizing permanent orders for protection and restraining orders after multiple violations or continued threats; amending Minnesota Statutes 2006, sections 518B.01, subdivisions 6, 6a, 11, 18; 609.748, subdivisions 3, 5, 8.

Representative Lillie moved HF 1625 before the committee.

Representative Hosch presented his bill.

Representative Lillie moved adoption of the DE2 amendment. THE MOTION PREVAILED.

Representative Lillie moved that HF 1625, as amended, be recommended to pass and be re-referred to the Public Safety and Civil Justice Policy Committee. THE MOTION PREVAILED.

HF 3007 (Simon): A bill for an act relating to public safety; prohibiting juveniles under the age of 16 from waiving their right to counsel during custodial interrogations except if the waiver is made by the juvenile’s attorney or parent; amending Minnesota Statutes, section 260B.175, by adding a subdivision.

Representative Kalin moved HF 3007 before the committee.

Representative Kalin moved adoption of the A2 amendment. THE MOTION PREVAILED.

Representative Simon presented his bill.

Representative Kalin moved that HF 3007, as amended, be recommended to pass and be re-referred to the Public Safety and Civil Justice Policy Committee.
