PUBLIC SAFETY AND CIVIL JUSTICE POLICY COMMITTEE MINUTES



Representative Mullery, Chair, called the meeting to order at 12:50 P.M. on Thursday, March 1, 2007, in Room 10 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Representative Holberg moved approval of the Minutes for February 27, 2007. THE MOTION PREVAILED AND THE MINUTES WERE APPROVED.

HF 455 (Murphy, M): A bill for an act relating public defense; updating and clarifying public defense provisions of law; eliminating defendant representation co-payments; providing for appointment of a chief public defender; amending Minnesota Statutes 2006, sections 270A.03, subdivision 5; 611.14; 611.17; 611.20, subdivision 6; 611.215, subdivisions 1, 1a; 611.23; 611.24; 611.25, subdivision 1; 611.26, subdivisions 2, 6, 7; 611.27, subdivisions 13, 15; 611.35; repealing Minnesota Statutes 2006, section 611.20, subdivision 5.

Representative Holberg moved HF 455 before the committee.

Representative Holberg moved the H0455DE1 delete everything amendment. THE AMENDMENT WAS ADOPTED.

Representative Murphy, M., presented the bill, as amended.

Representative Holberg moved that HF 455, as amended, be recommended to pass, and when so passed, be placed on the Consent Calendar. THE MOTION PREVAILED.

HF 1008 (Johnson): A bill for an act relating to public safety; changing certain background check requirements; amending Minnesota Statutes 2006, section 260C.209, subdivision 3.

Representative Johnson moved that HF 1008 be recommended to pass, and when so passed, be placed on the Consent Calendar. THE MOTION PREVAILED.

HF 505 (Hilstrom): A bill for an act relating to harassment; authorizing use of restraining orders against Internet and other computer systems publishing harassing information; amending Minnesota Statutes 2006, section 609.748, subdivisions 1, 5.

Representative Hilstrom moved adoption of the A07-0152 amendment. THE AMENDMENT WAS ADOPTED.

Representative Hilstrom presented HF 505.

Chair Mullery laid the bill over for possible inclusion in the Public Safety and Civil Justice Policy Committee omnibus bill.

HF 1166 (Haws): A bill for an relating to traffic regulations; imposing petty misdemeanor penalty for certain motor vehicle hit-and-run offenses; amending Minnesota Statutes 2006, section 169.09, by adding a subdivision.

Chair Mullery moved HF 1166 before the committee.

Chair Mullery moved adoption of the H1166A2 amendment. THE AMENDMENT WAS ADOPTED.

Representative Haws presented HF 1166, as amended.

Chair Mullery laid the bill over for possible inclusion in the Public Safety and Civil Justice Policy Committee omnibus bill.
