MINUTES


Chair Wagenius called the meeting to order at 8:10 A.M. on March 18th, 2008, in Room 10 of the State Office Building.

The Committee Legislative Assistant noted the roll.

HF3997 Bunn, Land disposal facilities siting prohibited in certain areas.

Representative Bunn presented information on her bill.

A quorum was present at 8:20 A.M.

Representative Bunn presented the H3997DE2 amendment.

Dale Setterholm, Associate Director of the Minnesota Geological Survey, testified on the bill and amendment.

Julie Ketchum, Director of Government Affairs for Waste Management.

Terry Johnson, Director of Groundwater Protection for Waste Management.


HF863 Hortman, California vehicle emissions standards adopted, and updates provided to comply with the federal Clean Air Act.

Chair Wagenius moved the bill for consideration.

Representative Hortman presented her bill.

Representative Hansen moved the A08-1435 amendment. Representative Hortman spoke in favor of the amendment. THE MOTION PREVAILED AND THE AMENDMENT IS ADOPTED.

Representative Dill moved the H0863A8 amendment and explained his amendment.

Representative Hortman moved an oral amendment to the amendment as follows: line 1.3, after "standards", insert "referred to in this section".

Representative Dill incorporated the oral amendment into his amendment and renewed his motion. THE MOTION PREVAILED AND THE H0863A8 AMENDMENT AS AMENDED IS ADOPTED.

Representative Dill moved the H0863A9 amendment.

Representative Hortman spoke against the amendment.

Representative Dill renewed his motion. THE MOTION FAILED.

A division was requested.

On a division of 6 ayes and 10 nays, THE MOTION FAILED.

HF863 as amended was laid over.


The committee recessed at 9:49 A.M.

The committee reconvened at 4:14 P.M.


HF3238 Gardner, Sustainable water use provided; conservation rate structures, contaminated well disclosure, and groundwater information sharing required, and advisory committee expiration date extended.

Representative Gardner moved his bill for possible inclusion and presented it.

Jim Japs, Assistant Director, DNR Division of Waters, testified on the fiscal note.

The bill was laid over.


HF3437 Moe, Star lake or river designation process provided, star lake or river signs allowed on highways, report required, and money appropriated.

Representative Moe moved his bill to be laid over and presented the bill.

John Jaschke, Executive Director, Board of Soil and Water Resources (BWSR), testified on the bill.

Representative Peterson presented the A08-1402 amendment.

Bob Meier, DNR Assistant Commissioner, testified in opposition to the amendment.

Representative Peterson moved his amendment. THE MOTION PREVAILED AND THE A08-1402 AMENDMENT IS ADOPTED.

The bill as amended was laid over.


HF3898 Dill, Timber sales refunds required, and forest fragmentation study funding provided, and money appropriated.

Representative Dill moved and presented his bill for possible inclusion.

Discussion ensued as to whether the bill should be heard in the Claims committee.

The bill was laid over.


HF3068 Dill, Snowmobile registration and sticker expiration date provided, temporary permit effective period extended for snowmobiles, off-highway motorcycles, all-terrain vehicles, and watercraft, and temporary permit information requirements modified.

Representative Dill moved and presented his bill for possible inclusion.

The bill was laid over.


HF3547 Dill, Omnibus game and fish bill.

Representative Dill moved his bill for possible inclusion.

Representative Dill moved the A08-1439 amendment.

Ed Boggess, Deputy Director of DNR's Fish and Wildlife Division, testified on the amendment.

Lou Cornicelli, Big Game Coordinator, DNR Fish and Wildlife Division, testified on the amendment.

Ed Boggess testified on the fiscal impact of the amendment.

Representative Dill withdrew the A08-1439 amendment.

Representative Dill moved the H3547A6 amendment.

Ed Boggess testified on the amendment.

Bob Meier testified on the amendment.

Representative Dill renewed his motion. THE MOTION PREVAILED AND THE H3547A6 AMENDMENT IS ADOPTED.

Representative Dill moved the H3547A7 amendment.

Ed Boggess testified on the amendment.

Pat Watts, Policy and Legal Analyst with DNR's Enforcement Division, testified on the amendment.

Representative Dill renewed his motion. THE MOTION PREVAILED AND THE H3547A7 AMENDMENT IS ADOPTED.

Representative McNamara moved and presented the H3547A8 amendment.

Representative Dill moved an oral amendment to the amendment as follows: line 1.6, delete "or", insert a comma, and after "fish house", insert "or shelter". THE MOTION PREVAILED AND THE ORAL AMENDMENT TO THE AMENDMENT IS ADOPTED.

Representative Dill moved the following oral amendment to the amendment as amended: line 1.6, after "shelter", insert "that is offered for rent and".

Discussion ensued.

Representative Dill withdrew his oral amendment to the amendment.

A vote was taken on the H3547A8 amendment as amended. THE MOTION PREVAILED AND THE H3547A8 AMENDMENT AS AMENDED IS ADOPTED.

Representative Dill moved the H3547A9 amendment.

Ed Boggess testified on the amendment.

A vote was taken. THE MOTION PREVAILED AND THE H3547A9 AMENDMENT IS ADOPTED.

HF3547 was laid over.


HF3273 Eken, State park provisions modified relating to park names, permits, campfires and forest roads; all-terrain vehicle provisions modified, authority modified for monument designation and water access site acquisition, and requirements eliminated.

Representative Eken moved and presented his bill for possible inclusion.

The bill was laid over.
