Representative Carlson, Chair of the Finance Committee, called the meeting to order at 8:19 A.M. on Wednesday, April 25, 2007, in Room 200 of the State Office Building.

The Committee Legislative Assistant noted the roll.

Rep. Huntley moved approval of the minutes of Tuesday, April 24, 2007. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Rep. Wagenius moved adoption of the Environment and Natural Resources Finance Division Report on HF1116, Second Committee Engrossment. (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/CEH1116.2.pdf). THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Rep. Wagenius moved that HF1116, Second Committee Engrossment, be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Dill presented HF1116, Second Committee Engrossment (Dill) Game and fish definitions, fees, license and stamp provisions, and possession and taking provisions modified; apprentice hunter validation provided; commercial fishing provisions modified; and criminal and civil penalties imposed.

Chair Carlson moved to amend HF1116, Second Committee Engrossment. (See attached amendment H1196A1).

Ed Boggess, Deputy Director, Division of Fish and Wildlife, Minnesota Department of Natural Resources, responded to questions regarding the proposed Amendment H1196A1.
Jim Conrad, Captain, Enforcement Division Manager, Minnesota Department of Natural Resources, responded to questions regarding the proposed Amendment H1196A1.

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Wagenius moved to amend HF1116, Second Committee Engrossment, as amended. (See attached amendment H1116A13). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.


Rep. Rukavina moved to amend HF1116, Second Committee Engrossment, as amended. (See attached amendment A07-0877).

Bob Meier, Assistant Commissioner, Policy and Government Relations, Minnesota Department of Natural Resources, responded to questions regarding Amendment A07-0877.

THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Cornish moved to amend HF1116, Second Committee Engrossment, as amended. (See attached amendment H1116A12), incorporating the following change to the amendment as follows:

Page 1, line 3, delete "23" and insert "26"

Chair Carlson moved to amend HF1116, Second Committee Engrossment, as amended, as follows:

Rep. Dill presented HF904, Second Committee Engrossment (Dill) Land acquisition, land
owners' bill of rights, and mineral interest record requirements modified; state park additions and
deletions provided; and public and private sales and conveyances of state lands authorized.

Kathy Lewis, Attorney, Minnesota Department of Natural Resources, responded to questions regarding HF904, Second Committee Engrossment.

Chair Carlson moved to amend HF904, Second Committee Engrossment. (See attached amendment A07-0844).

Vice Chair Sailer assumed chair at 9:16 A.M.

Kathy Lewis, Attorney, Minnesota Department of Natural Resources, responded to questions regarding the proposed Amendment A07-0844.

Chair Carlson resumed chair at 9:19 A.M.

Kathy Novak, House Research, explained a technical amendment to Amendment A07-0844.

Chair Carlson incorporated the following change to Amendment A07-0844, as follows:

Page 1, delete line 11

Rep. Westrom moved to amend HF904, Second Committee Engrossment, as amended. (See attached amendment H0904A1).

Kent Lokkesmo, Director, Division of Waters, Minnesota Department of Natural Resources responded to questions regarding the proposed Amendment H0904A1.

Craig Johnson, League of Minnesota Cities, responded to questions regarding the proposed Amendment H0904A1.

A division was requested on the motion amend HF904, Second Committee Engrossment, as amended. (See attached amendment H0904A1).

There were 14 Ayes and 13 nays. THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Rukavina moved to amend HF904, Second Committee Engrossment, as amended. (See attached amendment A07-0843), incorporating the following change to the amendment as follows:
Page 1, delete line 13

Rep. Rukavina moved to amend HF904, Second Committee Engrossment, as amended. (See attached amendment A07-0653), incorporating the following change to the amendment as follows:
Page 1, line 8, delete "point of navigability" and insert "ordinary low water mark"

THE MOTION PREVAILED. THE AMENDMENT, AS AMENDED, WAS ADOPTED.

Rep. Rukavina moved to amend HF904, Second Committee Engrossment, as amended. (See attached amendment A07-0861).

A division was requested on the motion. There were 13 ayes and 13 nays. THE MOTION FAILED. THE AMENDMENT WAS NOT ADOPTED.

Rep. Wagenius renewed the motion that HF904, Second Committee Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Wagenius moved adoption of the Environment and Natural Resources Finance Division Report on HF1420, First Committee Engrossment. (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/CEH1420.1.pdf). THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Rep. Poppe moved that HF1420, First Committee Engrossment, be recommended to pass and be placed on the General Register

Rep. Poppe presented HF1420, First Committee Engrossment (Poppe) Individual sewage
treatment design, installation, maintenance, inspection, and operation licensing requirements modified.

Rep. Poppe renewed the motion that HF1420, First Committee Engrossment, be recommended to pass and be placed on the General Register. THE MOTION PREVAILED.

Rep. Jaros moved adoption of the Minnesota Heritage Finance Division Report for HF2068. (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/HF1638.0.pdf). THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Rep. Jaros moved that HF2068 be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Jaros presented HF2068 (Jaros) Minnesota Film and TV Board funding provided, and money appropriated.

Rep. Jaros moved to amend HF2068. (See attached amendment H0268DE2). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.


Rep. Jaros renewed the motion that HF2068, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

Rep. Kahn presented HF1638 (Kahn) (See language at
http://wdoc.house.leg.state.mn.us/leg/LS85/HF1638.0.pdf). Grants management process,
governance, and structure established; and money appropriated.

Rep. Kahn moved that HF1638 be recommended to pass and re-referred to the Committee on Ways and Means.

Kahn Moved to amend HF1638. (See attached amendment H1638A3). THE MOTION PREVAILED. THE AMENDMENT WAS ADOPTED.

Rep. Kahn moved that HF1638, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.

SF1443 (Carlson) Northwest Airlines, Inc., mechanics unemployment benefits eligibility and extra benefits provided.
SF1393 (Rest) Supplemental education service providers approval rules modified.
To the Division on Health Care and Human Services Finance.
SF900 (Berglin) Long-Term Care Patient Access to Pharmaceuticals Act established, and penalties provided.
To the Division on Public Safety Finance.
SF890 (Olson, M.) Domestic abuse no contact order repeat violator felony penalty imposed, and qualified domestic violence-related offenses defined.
