Representative Carlson, Chair of the Finance Committee, called the meeting to order at 8:05 A.M. on Thursday, April 26, 2007, in Room 10 of the State Office Building.

The Committee Legislative Assistant noted the roll.

A quorum was present.

Rep. Hilty moved approval of the minutes of Wednesday, April 25, 2007. THE MOTION PREVAILED. THE MINUTES WERE APPROVED.

Rep. Peterson, A. presented HF2253, First Committee Engrossment (Peterson, A.) Community-based energy development projects provisions modified, renewable energy projects regulated, Public Utilities Commission policies required, wind energy permits authorized, and renewable energy option program sunset repealed.

Rep. Hilty moved adoption of the Energy Finance and Policy Division Report for
HF2253, First Committee Engrossment. (See language at
http://www.revisor.leg.state.mn.us/bin/showPDF.php). THE MOTION PREVAILED AND
THE DIVISION REPORT WAS ADOPTED.

Rep. Hilty moved that HF2253, First Committee Engrossment, be recommended to pass and re-referred to the Committee on Ways and Means.

HF2253, First Committee Engrossment, was temporarily laid over.

Rep. Hilty moved adoption of the Energy Finance and Policy Division Report for
HF436, First Committee Engrossment. (See language at
http://wdoc.house.leg.state.mn.us/leg/LS85/CEH0436.1.pdf). THE MOTION
PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Rep. Hilty presented SF145/HF436 (Hilty) Next Generation Energy Act of 2007 adopted
establishing energy policy goals, and providing for renewable energy obligations.

Rep. Hilty moved that SF145, First Engrossment be recommended to pass and re-referred
to the Committee on Ways and Means.


Rep. Hilty moved to delete the language in SF145, First Engrossment and insert the
language from HF436, First Committee Engrossment. THE MOTION PREVAILED.

Rep. Hilty renewed moved that SF145, First Engrossment, as amended, be recommended to pass
and re-referred to the Committee on Ways and Means. THE MOTION REVAILED.

Rep. Hilty renewed the motion that HF2253, First Committee Engrossment, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION REVAILED.

Vice Chair Sailer assumed chair at 8:40 A.M.

Rep. Kahn moved adoption of the State Government Finance Division Report for
SF538, First Committee Engrossment. (See language at
http://www.revisor.leg.state.mn.us/bin/showPDF.php). THE MOTION PREVAILED AND
THE DIVISION REPORT WAS ADOPTED.

Rep. Kahn moved that SF538, First Committee Engrossment be recommended to pass and be placed on the General Register.

Rep. Peterson, A. presented SF538 (Peterson, A.) Heating and cooling policy for state building projects established.

Rep. Juhnke moved to amend SF538, First Committee Engrossment, as follows:

Page 1, line 8, delete "and study" and insert "project proposers study for"

THE MOTION PREVALED. THE AMENDMENT WAS ADOPTED.

Rep. Kahn renewed motion moved that SF538, First Committee Engrossment, as amended, be recommended to pass and be placed on the General Register. THE MOTION REVAILED.

Chair Carlson resumed chair at 8:45 A.M.

Chair Carlson moved adoption of the Higher Education and Workforce Development Finance Division Report for HF1283, Second Committee Engrossment. (See language at http://wdoc.house.leg.state.mn.us/leg/LS85/CEH1283.2.pdf). THE MOTION PREVAILED AND THE DIVISION REPORT WAS ADOPTED.

Rep. Nelson presented HF1283 (Nelson) Independent contractor exemption certificates required, penalties provided, notice to the commissioners of revenue and employment and economic development authorized, and review of certifications of independent contractor status required.

Rep. Rukavina moved that HF1283, Second Committee Engrossment, be recommended to pass and re-referred to the Committee on Ways and Means.

Rep. Rukavina moved to amend HF1283, Second Committee Engrossment. (See attached delete everything amendment H1283DE3).

Rep. Rukavina incorporated the following amendments into Amendment HF1283DE3:

The attached amendment H1283A7, and;

Page 8, after line 26, insert:

"Sec.3. REPEALER.

Minnesota Statutes 2006, sections 176.042; and 268.035, subdivision 9, are repealed.

EFFECTIVE DATE. This section is effective January 1, 2009."


THE MOTION PREVAILED. THE AMENDMENT, AS AMENDED, WAS ADOPTED.



Rep. Rukavina renewed the motion that HF1283, Second Committee Engrossment, as amended, be recommended to pass and re-referred to the Committee on Ways and Means. THE MOTION PREVAILED.
