Representative Jim Knoblach, Chair, called the thirty-eighth meeting to order at 12:44 p.m. on Monday, April 10, 2006 in Room 200 of the State Office Building.

The Clerk noted the roll.

Representative Knoblach called the meeting to order at 12:44. A quorum was present.

Representative McNamara moved that the minutes of April 5, 2006 be recommended to pass. THE MOTION PREVAILED.

HF2959 Dorman Omnibus bonding bill providing capital improvements funding for various public projects, issuing bonds, and appropriating money.

Representative Dorman moved that HF2959, first engrossment, be recommended to pass and be sent to the General Register.

Representative Dorman testified on HF2959, first engrossment.

Representative Dorman moved the H2959A19 amendment. THE AMENDMENT WAS ADOPTED.

Representative Solberg moved the H2959A17 amendment.

Representative Solberg, Representative Lanning, Burt McKasy, Erick Bartsch, Ray Bohn, Red River Water Shed Districts, Jerry Vonkoff, Middle Rien, Kent Lokkesmoe, Director of Waters, Minnesota Department of Natural Resources, testified on the H2959A17 amendment. THE AMENDMENT WAS ADPOTED.




Representative Solberg renewed his motion that the H2959A17 amendment be adopted. THE AMENDMENT WAS ADOPTED.

Representative Sykora moved the H2959A16 amendment.

Representative Sykora and Mark Holsten, Deputy Commissioner, Minnesota Department of Natural Resources testified on the H2986A16 amendment.

Representative Sykora renewed her motion that the H2959A16 amendment be adopted.
THE AMENDMENT WAS ADOPTED

Representative Vandaveer moved the H2959A12 amendment and requested a roll call vote. The results were as follows:

Representative Dorman moved that HF2959, as amended, be recommended to pass. THE MOTION PREVAILED.

The meeting was recessed 2:34 p.m.

The meeting was reconvened at 6:48 p.m.

HF3258 Brod Abortion notification data reporting required and civil penalties provided.

Representative Knoblach moved that HF3258, 2nd engrossment, be recommended to pass.

Representative Brod and Andrea Rau, Minnesota Citizens Concerned for Life
testified on HF3258, second engrossment.

Representative Knoblach moved to orally amend HF3258, second engrossment, by: P.6, after L.15, insert: "The Department of Human Services must absorb any litigation or legal costs associated with Section 4”. THE ORAL AMENTMENT WAS WITHDRAWN.

Representative Knoblach renewed his motion that HF3258, second engrossment be recommended to pass.

HF2833 Seifert Supplemental state government appropriations funding provided, state and local governmental operations regulated, legislative provisions modified, unfunded mandates moratorium imposed, labor agreements ratified, and money appropriated.

Representative Seifert moved that HF2833, first engrossment, be recommended to pass.

Representative Seifert moves to orally amend HF2833, first engrossment by: P.126, L.30 delete, “414.0325 or” THE ORAL AMENDMENT WAS ADOPTED.

Representative Seifert moved the H2833A34 amendment. THE AMENDMENT WAS ADOPTED.

Representative Seifert moved the H2833A40 amendment. THE AMENDMENT WAS ADOPTED.

Representative Seifert moved the H2833A35 amendment. THE AMENDMENT WAS ADOPTED.

Representative Smith moved the H2833A37 amendment. THE AMENDMENT WAS ADOPTED.

Representative Solberg moved the H2833A50 amendment. THE AMENDMENT WAS ADOPTED.

Representative Bradley moved the H2833A38 amendment. THE AMENDMENT WAS ADOPTED.

Representative Hilty moved the H2833A46 amendment.

Representative Hilty, Representative Seifert, Ken Slone, Minnesota Association of Townships, and Judy Sanders, National Federation for the Blind testified on the H2833A46 amendment.

Representative Hilty renewed his motion that the H2833A46 amendment be adopted. On a division of 14 AYES and 18 NAYS THE AMENDMENT WAS NOT ADOPTED.

Representative Seifert moved to orally amend HF2833 by: P.56, delete, “section 15”. THE ORAL AMENDMENT WAS ADOPTED.

Representative Hilty moved the H2833A43 amendment.

Representative Hilty moved to orally amend the H2833A43 amendment by: P.1, L.1.11 add a comma after 8200.1700, delete, “ and”, after 8200.3700 add, and 829310, sub.4. THE ORAL AMENDMENT TO THE AMENDMENT WAS INCORPORATED.

Representative Hilty renewed his motion that H2833A43 amendment be adopted. THE AMENDMENT WAS ADOPTED.

Representative Hilty moved the H2833A33 amendment. . THE AMENDMENT WAS ADOPTED.

Representative Solberg moved the H2833A47 amendment. THE AMENDMENT WAS ADOPTED.

Representative Seifert moved to orally amend H2833, second engrossment, by P. 79, L.79.13,
delete: “located in whole or in part in Minnesota,” P. 79, L.79.17, delete: “located in whole or in part in Minnesota” THE ORAL AMENDMENT WAS ADOPTED.

Representative Abrams moved to orally amend HF2833 by: P. 57, delete, “section 118”, P. 65, delete. “Section 137”. On a division of 16 AYES and 17 NAYS THE ORAL AMENDMENT WAS NOT ADOPTED.

Representative Vandaveer moved the H2833A32 amendment.

Representative Vandaveer, Kari Thurlow, Coalition of Greater Minnesota Cities, Nancy Lawson, Executive Director, Minnesota Association of Small Cities, Kent Salen, Minnesota Township Association testified on the H2833A32 amendment.

Representative Vandaveer renewed his motion that the H2833A32 amendment be adopted. THE AMENDMENT WAS ADOPTED.

Representative Vandaveer moved the H2833A36 amendment. THE AMENDMENT WAS WITHDRAWN.

Representative Mariani moved the H2833A49 amendment.

Representative Mariani moved to orally amend the H2833A49 amendment by: L.1.2, “delete, and 46”. THE ORAL AMENDMENT WAS INCORPORATED.

Representative Mariani moved that the H2833A49 amendment, as amended, be adopted. THE MOTION PREVAILED.

Representative Kelliher moved the H2833A48 amendment. THE AMENDMENT WAS ADOPTED.

Representative Wagenius moved to orally amend HF2833, second engrossment, by: P. 24 & 25, delete, “Section 43”. THE ORAL AMENDMENT WAS ADOPTED.

Representative Rukavina moved to orally amend HF2833 by: P. 28, delete “Section 52”. On a division of 16 NAYS and 19 AYES THE ORAL AMENDMENT WAS NOT ADOPTED.


Representative Hilty moved to orally amend HF2833, first engrossment by: P. 28, delete, “L. 31thur 33”. On a division of 19 AYES to 16 NAYS THE ORAL AMENDMENT WAS ADOPTED.

Representative Mariani moved to orally amend HF2388, first engrossment by: P. 25, delete,
“Section 44”. THE ORAL AMENDMENT WAS ADOPTED.

Representative Abrams raised a point of order under rule 4.11. THE POINT OF ORDER WAS WITHDRAWN.

Representative Abrams moved to orally amend HF2388, first engrossment, by; P.57, delete, “Section 118, P.65, delete, “Section 137”, and P.61, delete, “Section 138”. On a division of 22 AYES and 10 NAYS THE AMENDMENT WAS ADOPTED.

Representative Seifert moved that HF2833, second engrossment, as amended, be recommended to pass. THE MOTION PREVAILED.

SF2734 Hackbarth Constitutional amendment for sales tax dedication to natural and cultural resources purposes; arts, humanities, museum and public broadcasting, heritage enhancement, parks and trails funds and clean water and heritage enhancement councils.

Representative Hackbarth testified on SF2734.

Representative Dorman moved to orally amend SF2734 by: P. 6 & 7, delete ‘Articles 3&4”.

Representative Krinkie requested a roll call vote. The results were as follows:
