Representative Mark Olson, Chair of the Local Government Committee, called the tenth meeting to order at 12:32 P.M. on Wednesday, February 14, 2005, in Room 10 of the State Office Building.

The Clerk noted the roll.

HILSTROM, Debra moved the Minutes of February 9, 2005 be approved as prepared by the Clerk. THE MOTION PREVAILED


HF0228 (Paymar) Municipal prohibition on termination by amortization limited to exclude nonconforming billboards.

PAYMAR, Michael moved HF0228 be recommended to pass and referred to the Committee on Civil Law and Elections.

The following provided testimony on and responded to the Committee’s questions regarding HF0288:

Peter Coyle (1500 Wells Fargo Plaza, 7900 Xerxes Av S, Minneapolis, MN, 55431) on behalf of the Outdoor Advertising Association of Minnesota; LeAnn Muller, and Chris McCarver, Clear Channel Outdoor - Minnesota, 3225 Spring St NE, Minneapolis, MN, 55413; Diane Hoey, owner, Schubert Hoey, 2747 26th Av S, Minneapolis, MN, 55406; and John Bodger (4777 Shady Oak Rd, Minnetonka, MN, 55343), Real Estate Manager, Viacom Outdoor Advertising, 4300 Baker Rd, Hopkins, MN, 55343.

HORNSTEIN, Frank moved to recommend the following amendment:

Page 1, Line 13, after "billboards" insert "in St. Paul"

At the request of the Chief Author and without objection THE MOTION to recommend adoption of the amendment PREVAILED.

CORNISH, Tony requested a Roll Call vote on the Main Motion.

The question re-occurred on the Paymar Motion to recommend that HF0228 be amended, and when so amended, be recommended to pass and be re-referred to the Committee on Civil Law and Elections.

HF0647 (Peterson, A.) Ban on public officers having an interest in a volunteer ambulance service contract exception provided.

The following provided testimony on and responded to the Committee’s questions regarding HF0647:

Representative Aaron Peterson; and Allan Johnson (448 Rooney Av E, Appleton, MN 56208).

HORNSTEIN, Frank moved HF0547 be recommended to pass. THE MOTION PREVAILED


HF0478 (Erickson) Alternative filing of surveys provided when there is no county surveyor.

OLSON, Mark moved that HF0478 be recommended to pass.

The following provided testimony on and responded to the Committee’s questions regarding HF0478:

Representative Sondra Erickson; Don Granlund, 8366 165th Av, Oak Park, MN, 56357; and Charles Fischer, 8663 165th Av, Foley, MN, 56329.

At the request of the Chief Author and without objection HF0478 was laid on the table until the next meeting of the Committee.


HF0209 (Blaine) Township levy and spending authority clarified.

OLSON, Mark moved that HF0209 be recommended to pass and be referred to the Committee on Taxes.

The following testified on and responded to the Committee’s questions regarding HF0209:

Representative Greg Blaine; and Kent Sulem, Attorney, MN Association of Townships, 805 Central Av E, P.O. Box 267, St. Michael, MN, 55376.

The question re-occurred on the Olson Motion to recommend that HF0209 be recommended to pass and be re-referred to the Committee on Taxes. THE MOTION PREVAILED
