MINUTES

Representative Tom Hackbarth, Chair of the Environment & Natural Resources Policy Committee, called the twenty-first meeting to order at 12:45 p.m. on April 5, 2005, in the Basement Hearing Room of the State Office Building.

The Clerk noted the roll.

12:45:44 PM Rep. Hansen moved the minutes of the Environment & Natural Resources Committee, dated March 30, 2005.

THE MOTION PREVAILED
12:46:31 PM HF460 (Hackbarth) Off-highway vehicle provisions and forest classification review modified, and rulemaking exemptions provided

Rep. Hackbarth moved that HF460 be recommended to pass and be placed on the General Register.
12:48:54 PM Rep. Hackbarth moved the A05-0471 amendment.

Rep. Hackbarth incorporated an oral amendment to read as follows:

Page 8, line 31 “any new language in paragraph (a) will be deleted”
12:50:13 PM Rep Hansen moved an oral amendment to read as follows:

Page 4, line 29 after "(c)" insert "Notwithstanding paragraphs (a) and (b),"
Page 4, line 29 after "commissioner" insert "with the approval of the commissioner’s of Health and the Pollution Control Agency"
Page 4, line 30 after "permits" insert "on an annual basis"

Rep. Hackbarth renewed his motion that the HFA05-0471 amendment, as amended, be adopted.

Rep. Mariani explained the amendment.
12:57:22 PM Rep. Mariani moved that the H1547DE2 be an add on amendment rather than a delete everything amendment. Rep. Mariani moved to incorporate an oral amendment to read as follows:

12:59:27 PM Audubon Society, Susan Solterman, testified on the amendment.
1:03:35 PM Trout Unlimited, Kevin Biegler & Dave Engebretson, a citizen, testified on the amendment.
1:11:13 PM Minnesota Center for Environmental Advocacy, Matt Norton, testified on the amendment.
1:24:48 PM Rep. Mariani moved to incorporate an oral amendment to read as follows:

Page 1, line 17 between "not" and "operate" insert "knowingly"
1:28:14 PM Rep. Mariani moved to incorporate an oral amendment to read as follows:

1:30:47 PM Rep. Wagenius moved an oral amendment to read as follows:

Page 1, line 22 after "vehicle" strike the "; " insert ", or (iii) in a organized event on private property;"

Rep. Mariani incorporated the oral amendment into the H1547DE2 amendment.
1:35:20 PM Rep. Mariani renewed his motion to adopt the H1547DE2 amendment.
