1.3    "Sec. 114. Minnesota Statutes 2014, section 116.02, subdivision 1, is amended to read:
1.4    Subdivision 1. Creation. A pollution control agency, designated as the Minnesota
1.5Pollution Control Agency, is hereby created. The agency shall consist of the commissioner
1.6and eight members appointed by the governor, by and with the advice and consent of the
1.7senate. One of such members shall be a person knowledgeable in the field of agriculture
1.8and one shall be representative of organized labor.

1.9    Sec. 115. Minnesota Statutes 2014, section 116.02, subdivision 5, is amended to read:
1.10    Subd. 5. Agency is successor to commission. The Pollution Control Agency is
1.11the successor of the Water Pollution Control Commission, and all powers and duties
1.12now vested in or imposed upon said commission by chapter 115, or any act amendatory
1.13thereof or supplementary thereto, are hereby transferred to, imposed upon, and vested in
1.14the Minnesota commissioner of the Pollution Control Agency, except as to those matters
1.15pending before the commission in which hearings have been held and evidence has been
1.16adduced. The Water Pollution Commission shall complete its action in such pending
1.17matters not later than six months from May 26, 1967. The Water Pollution Control
1.18Commission, as heretofore constituted, is hereby abolished, (a) effective upon completion
1.19of its action in the pending cases, as hereinbefore provided for; or (b) six months from
1.20May 26, 1967, whichever is the earlier.

1.21    Sec. 116. Minnesota Statutes 2014, section 116.03, subdivision 1, is amended to read:
1.22    Subdivision 1. Office. (a) The Office of Commissioner of the Pollution Control
1.23Agency is created and is under the supervision and control of the commissioner, who is
1.24appointed by the governor under the provisions of section 15.06.
2.1(b) The commissioner may appoint a deputy commissioner and assistant
2.2commissioners who shall be in the unclassified service.
2.3(c) The commissioner shall make all decisions on behalf of the agency that are not
2.4required to be made by the agency under section 116.02.

2.5    Sec. 117. Minnesota Statutes 2014, section 116.03, subdivision 2a, is amended to read:
2.6    Subd. 2a. Mission; efficiency. It is part of the agency's mission that within the
2.7agency's resources the commissioner and the members of the agency shall endeavor to:
2.8(1) prevent the waste or unnecessary spending of public money;
2.9(2) use innovative fiscal and human resource practices to manage the state's
2.10resources and operate the agency as efficiently as possible;
2.11(3) coordinate the agency's activities wherever appropriate with the activities of
2.12other governmental agencies;
2.13(4) use technology where appropriate to increase agency productivity, improve
2.14customer service, increase public access to information about government, and increase
2.15public participation in the business of government;
2.16(5) utilize constructive and cooperative labor-management practices to the extent
2.17otherwise required by chapters 43A and 179A;
2.18(6) report to the legislature on the performance of agency operations and the
2.19accomplishment of agency goals in the agency's biennial budget according to section
2.2016A.10, subdivision 1 ; and
2.21(7) recommend to the legislature appropriate changes in law necessary to carry out
2.22the mission and improve the performance of the agency."

2.24"(e) The commissioners of the Pollution Control Agency and natural resources shall
2.25apply Minnesota Rules, parts 7001.3050, subpart 3, item G, and 7035.2525, subpart 2,
2.26item G, to solid waste facilities permitted under and in compliance with those rules and in
2.27compliance with Minnesota Rules, chapter 6132."
