7.14(a) Except as provided in paragraph (b), the

7.17bonds sold to finance projects authorized
7.18by this section. After each sale of general
7.19obligation bonds, the commissioner of
7.20management and budget shall notify the
7.21board of the amounts assessed for each year
7.22for the life of the bonds.
7.23(b) The board need not pay debt service
7.24on bonds sold to finance HEAPR. Where a
7.25nonstate match is required, the debt service is
7.26due on a principal amount equal to one-third
7.27of the total project cost, less the match
7.28committed before the bonds are sold.
7.29(c) The commissioner of management and
7.30budget shall reduce the board's assessment
7.31each year by one-third of the net income
7.32from investment of general obligation bond
7.33proceeds in proportion to the amount of
7.34principal and interest otherwise required to
8.1be paid by the board. The board shall pay its
8.2resulting net assessment to the commissioner
8.3of management and budget by December
8.41 each year. If the board fails to make
8.5a payment when due, the commissioner
8.6of management and budget shall reduce
8.7allotments for appropriations from the
8.8general fund otherwise available to the board
8.9and apply the amount of the reduction to
8.10cover the missed debt service payment. The

50.23with the effect prescribed by Minnesota Statutes, sections 16A.631 to 16A.675, and by
50.24the Minnesota Constitution, article XI, sections 4 to 7. The proceeds of the bonds, except
50.25accrued interest and any premium received on the sale of the bonds, must be credited to
50.26a bond proceeds account in the state transportation fund.
50.27    Subd. 3. Maximum effort school loan fund. To provide the money appropriated in
50.28this act from the maximum effort school loan fund, the commissioner of management and
50.29budget shall sell and issue bonds of the state in an amount up to $5,491,000 in the manner,
50.30upon the terms, and with the effect prescribed by Minnesota Statutes, sections 16A.631 to
50.3116A.675, and by the Minnesota Constitution, article XI, sections 4 to 7. The proceeds of

57.11    Sec. 28. Laws 2013, chapter 136, section 7, is amended to read:
57.12    Sec. 7. BOND SALE SCHEDULE.
57.13The commissioner of management and budget shall schedule the sale of state
57.14general obligation bonds so that, during the biennium ending June 30, 2015, no more
57.15than $1,280,165,000 $1,253,992,000 will need to be transferred from the general fund to
57.16the state bond fund to pay principal and interest due and to become due on outstanding
57.17state general obligation bonds. During the biennium, before each sale of state general
57.18obligation bonds, the commissioner of management and budget shall calculate the amount
57.19of debt service payments needed on bonds previously issued and shall estimate the amount
57.20of debt service payments that will be needed on the bonds scheduled to be sold. The
57.21commissioner shall adjust the amount of bonds scheduled to be sold so as to remain within
57.22the limit set by this section. The amount needed to make the debt service payments is
57.23appropriated from the general fund as provided in Minnesota Statutes, section 16A.641.

57.24    Sec. 29. APPROPRIATIONS GIVEN EFFECT ONCE.
57.25    Except for appropriations to the local bridge replacement program under Minnesota
57.26Statutes, section 174.50, to the local road improvement fund grants under Minnesota
57.27Statutes, section 174.52, and for highway-rail crossing warning devices, if an appropriation
57.28in this act is enacted more than once in the 2014 legislative session for the same purpose,
57.29the appropriation must be given effect only once. If the appropriations for the same
57.30purpose are for different amounts, the lowest of the amounts is the one to be given effect.

57.31    Sec. 30. EFFECTIVE DATE.
57.32    This article is effective the day following final enactment.

58.1ARTICLE 2
58.2MISCELLANEOUS

58.3    Section 1. Minnesota Statutes 2012, section 16A.641, is amended by adding a
58.4subdivision to read:
58.5    Subd. 4b. Negotiated sales authority. Notwithstanding the public sale requirements
58.6of subdivision 4 and section 16A.66, subdivision 2, from June 1, 2009, until June 30,
58.72018, the commissioner may sell bonds, including refunding bonds, at negotiated sale.

58.8    Sec. 2. Minnesota Statutes 2012, section 16A.642, subdivision 1, is amended to read:
58.9    Subdivision 1. Reports. (a) The commissioner of management and budget shall
58.10report to the chairs of the senate Committee on Finance and the house of representatives
58.11Committees on Ways and Means and Capital Investment by January 1 of each
58.12odd-numbered year on the following:
58.13(1) all laws authorizing the issuance of state bonds, bonds supported by a state
58.14appropriation, or appropriating general fund money for state or local government
58.15capital investment projects enacted more than four years before January 1 of that
58.16odd-numbered year; the projects authorized to be acquired and constructed for which
58.17less than 100 percent of the authorized total cost has been expended, encumbered, or
58.18otherwise obligated; the cost of contracts to be let in accordance with existing plans and
58.19specifications shall be considered expended for this report; and the amount of general fund
58.20money appropriated but not spent or otherwise obligated, and the amount of bonds not
58.21issued and bond proceeds held but not previously expended, encumbered, or otherwise
58.22obligated for these projects; and
58.23(2) all laws authorizing the issuance of state bonds, bonds supported by a state
58.24appropriation, or appropriating general fund money for state or local government capital
58.25programs or projects other than those described in clause (1), enacted more than four years
58.26before January 1 of that odd-numbered year; and the amount of general fund money
58.27appropriated but not spent or otherwise obligated, and the amount of bonds not issued
58.28and bond proceeds held but not previously expended, encumbered, or otherwise obligated
58.29for these programs and projects.
58.30(b) The commissioner shall also report on general fund appropriations for capital
58.31projects, bond authorizations or bond proceed balances that may be canceled because
58.32projects have been canceled, completed, or otherwise concluded, or because the purposes
58.33for which the money was appropriated or bonds were authorized or issued have been
58.34canceled, completed, or otherwise concluded. The general fund appropriations, bond
58.35authorizations or bond proceed balances that are unencumbered or otherwise not obligated
59.1that are reported by the commissioner under this subdivision are canceled, effective July 1
59.2of the year of the report, unless specifically reauthorized by act of the legislature.
59.3(c) The reports required by this subdivision shall only contain bond authorizations
59.4supported by a state appropriation and their associated general fund appropriations for
59.5projects authorized or amended after December 31, 2013.

59.6    Sec. 3. Minnesota Statutes 2012, section 16A.642, subdivision 2, is amended to read:
59.7    Subd. 2. Cancellation. (a) If the commissioner determines that the purposes for
59.8which general obligation bonds of the state or bonds supported by a state appropriation
59.9 have been issued or for which general fund monies were appropriated are accomplished
59.10or abandoned, after consultation with the affected agencies, and there is a remaining
59.11authorization or appropriation for a specific project of $500 or less, the commissioner may
59.12cancel the remaining authorization or appropriation for that project. Bonds supported by
59.13a state appropriation shall only be canceled if they were authorized or amended after
59.14December 31, 2013.
59.15(b) If a premium received on the sale of bonds is credited to the bond proceeds
59.16fund, pursuant to section 16A.641, subdivision 7, paragraph (b), the corresponding bond
59.17authorization to which the premium is attributable must be reduced accordingly by the
59.18commissioner.
59.19(c) The commissioner must notify the chairs of the senate Finance Committee and
59.20the house of representatives Capital Investment Committee of any bond authorizations,
59.21including bond authorizations supported by a state appropriation, or general fund
59.22appropriations canceled under this subdivision.

59.23    Sec. 4. Minnesota Statutes 2012, section 16B.335, subdivision 1, is amended to read:
59.24    Subdivision 1. Construction and major remodeling. (a) The commissioner, or
59.25any other recipient to whom an appropriation is made to acquire or better public lands or
59.26buildings or other public improvements of a capital nature, must not prepare final plans and
59.27specifications for any construction, major remodeling, or land acquisition in anticipation of
59.28which the appropriation was made until the agency that will use the project has presented
59.29the program plan and cost estimates for all elements necessary to complete the project to the
59.30chair of the senate Finance Committee and the chair of the house of representatives Ways
59.31and Means Committee and the chairs have made their recommendations, and the chair and
59.32ranking minority member of the senate Capital Investment Committee and the chair and
59.33ranking minority member of the house of representatives Capital Investment Committee is
59.34 are notified. "Construction or major remodeling" means construction of a new building,
60.1a substantial addition to an existing building, or a substantial change to the interior
60.2configuration of an existing building. The presentation must note any significant changes in
60.3the work that will be done, or in its cost, since the appropriation for the project was enacted
60.4or from the predesign submittal. The program plans and estimates must be presented for
60.5review at least two weeks before a recommendation is needed. The recommendations are
60.6advisory only. Failure or refusal to make a recommendation is considered a negative
60.7recommendation. The chairs and ranking minority members of the senate Finance
60.8Committee and Capital Investment Committees and the house of representatives Capital
60.9Investment and Ways and Means Committees must also be notified whenever there is a
60.10substantial change in a construction or major remodeling project, or in its cost.
60.11(b) Capital projects exempt from the requirements of this subdivision include
60.12demolition or decommissioning of state assets, hazardous material projects, utility
60.13infrastructure projects, environmental testing, parking lots, parking structures, park
60.14and ride facilities, bus rapid transit stations, light rail lines, exterior lighting, fencing,
60.15highway rest areas, truck stations, storage facilities not consisting primarily of offices or
60.16heated work areas, roads, bridges, trails, pathways, campgrounds, athletic fields, dams,
60.17floodwater retention systems, water access sites, harbors, sewer separation projects, water
60.18and wastewater facilities, port development projects for which the commissioner of
60.19transportation has entered into an assistance agreement under section 457A.04, ice centers,
60.20a local government project with a construction cost of less than $1,500,000, or any other
60.21capital project with a construction cost of less than $750,000.

60.22    Sec. 5. Minnesota Statutes 2012, section 16B.335, subdivision 2, is amended to read:
60.23    Subd. 2. Other projects. All other capital projects for which a specific appropriation
60.24is made must not proceed until the recipient undertaking the project has notified the chairs
60.25and ranking minority members of the senate Capital Investment and Finance Committee
60.26 Committees and the house of representatives Capital Investment and Ways and Means
60.27Committees that the work is ready to begin. Notice is not required for capital projects
60.28needed to comply with the Americans with Disabilities Act, for asset preservation projects
60.29to which section 16B.307 applies, or for projects funded by an agency's operating budget
60.30or by a capital asset preservation and replacement account under section 16A.632, or a
60.31higher education asset preservation and replacement account under section 135A.046.

69.7    Subdivision 1. Harambee. Notwithstanding the appropriations of state general
69.8obligation bond proceeds in Laws 1994, chapter 643, section 14, subdivision 7, to Joint
69.9Powers District No. 6067, East Metro Integration District, to acquire and better the
69.10Harambee community school, in Maplewood, the real and personal property of the
69.11Harambee school may be conveyed to Independent School District No. 623, Roseville,
69.12for operation of a multidistrict integration facility that serves students in any grade from
69.13early education through grade 12.
69.14    Subd. 2. Crosswinds. Notwithstanding the appropriation of state general obligation
69.15bond proceeds in Laws 1998, chapter 404, section 5, subdivision 5; Laws 1999, chapter
69.16240, article 1, section 3; Laws 2000, chapter 492, article 1, section 5, subdivision 2; Laws
69.172001, First Special Session chapter 12, section 2, subdivision 2; and Laws 2005, chapter
69.1820, article 1, section 5, subdivision 3, to acquire and better the Crosswinds school facilities
69.19by the Joint Powers District No. 6067, East Metro Integration District, in Woodbury, the

69.22    Sec. 20. CONVEYANCE OF SURPLUS STATE LAND; WASHINGTON
69.23COUNTY.
69.24(a) Notwithstanding Minnesota Statutes, sections 16A.695 and 16B.281 to 16B.296,
69.25the commissioner of administration may convey to the city of Bayport for no consideration
69.26the surplus land that is described in paragraph (c).
69.27(b) The conveyance must be in a form approved by the attorney general and provide
69.28that the lands revert to the state if the city of Bayport stops using the land for the public
69.29purpose described in paragraph (d). The attorney general may make changes to the land
69.30description to correct errors and ensure accuracy.
