1.3    "Section 1. Minnesota Statutes 2020, section 119A.03, is amended to read:
1.4119A.03 COMMISSIONER.
1.5    Subdivision 1. General. The department is under the administrative control of the
1.6commissioner. The commissioner is appointed by the governor with the advice and consent
1.7of the senate. The commissioner must possess broad knowledge and experience in
1.8strengthening children and families. The commissioner has the general powers as provided
1.9in section 15.06, subdivision 6.
1.10The commissioner's salary must be established according to the procedure in section
1.1115A.0815, in the same range as that specified for the commissioner of management and
1.12budget.
1.13    Subd. 2. Duties of commissioner. The commissioner shall:
1.14(1) identify measurable outcomes by which programs administered by the department
1.15will be evaluated at the state and local level;
1.16(2) develop linkages with other state departments to ensure coordination and consistent
1.17state policies promoting healthy development of children and families;
1.18(3) prepare, in consultation with the Children's Cabinet and affected parties, prior to July
1.191 of each year, guidelines governing planning, reporting, and other procedural requirements
1.20necessary to administer this chapter;
1.21(4) facilitate inclusive processes when designing or implementing guidelines and strategies
1.22to achieve agency goals for children and families;
2.1(5) facilitate intergovernmental and public-private partnership strategies necessary to
2.2implement this chapter;
2.3(6) submit to the federal government, or provide assistance to local governments and
2.4organizations in submitting, where appropriate and feasible, requests for federal waivers or
2.5recommendations for changes in federal law necessary to carry out the purposes of this
2.6chapter;
2.7(7) coordinate review of all plans and other documents required under the guidelines
2.8provided for in clause (3);
2.9(8) coordinate development of the management support system components required
2.10for implementation of this chapter;
2.11(9) review other programs serving children and families to determine the feasibility for
2.12transfer to the Department of Education or the feasibility of inclusion in the funding
2.13consolidation process; and
2.14(10) monitor local compliance with this chapter.
2.15    Subd. 3. Fidelity to state statutes. The commissioner of education must allocate staff
2.16among positions specifically required by the duties imposed on the agency by state and
2.17federal law. The commissioner must not deploy staff paid with state funds for duties not
2.18required by state or federal law."
