1.3    "Sec. .... Minnesota Statutes 2020, section 124D.151, subdivision 4, is amended to read:
1.4    Subd. 4. Eligibility. (a) A child who is must be four years of age as of September 1 in
1.5the calendar year in which the school year commences is to be eligible to participate in a
1.6voluntary prekindergarten program free of charge.
1.7(b) A child is eligible to participate in a voluntary prekindergarten program free of charge
1.8if the child:
1.9(1) qualifies for free or reduced-price lunch;
1.10(2) is an English language learner;
1.11(3) is homeless;
1.12(4) has an individualized education program or individual interagency intervention plan;
1.13(5) is identified, through health and developmental screening under sections 121A.16
1.14to 121.19, with a potential risk factor that may influence learning; or
1.15(6) is in foster care.
1.16(c) A child who does not have at least one of the risk factors under paragraph (b) may
1.17participate in a voluntary prekindergarten program on a fee-for-service basis. A district or
1.18charter school must adopt a sliding fee schedule based on a family's income but must waive
1.19a fee for a participant unable to pay.
1.20An eligible four-year-old child served in a mixed-delivery system by a child care center,
1.21family child care program licensed under section 245A.03, or community-based organization
1.22may be charged a fee as long as the mixed-delivery partner was not awarded a seat for that
2.1child. (d) Each eligible child must complete a health and developmental screening within
2.290 days of program enrollment under sections 121A.16 to 121A.19, and provide
2.3documentation of required immunizations under section 121A.15.
2.4(e) Districts and charter schools must use voluntary prekindergarten aid for eligible
2.5children."
