1.4IMMIGRATION

1.5    Section 1. [116L.991] IMMIGRANT WORKER ENTERPRISE ZONES.
1.6(a) The commissioner shall establish immigrant worker enterprise zones within the state
1.7to encourage immigrant settlement and alleviate labor shortages. Immigrant worker enterprise
1.8zones are areas of the state identified by the commissioner to have labor shortages that can
1.9be alleviated by recruiting and attracting immigrant populations.
1.10(b) To identify immigrant worker enterprise zones in the state, the commissioner shall
1.11consider:
1.12(1) the distribution of immigrant workers by region of the state;
1.13(2) the size and growth of the immigrant workforce in the state;
1.14(3) industries in the state that rely on immigrant workers and the impact that immigrant
1.15workers have on certain industries and regions in the state; and
1.16(4) the services immigrant workers need to integrate into the community, including
1.17housing, education, health care, and citizenship, and the public and private sector agencies
1.18or organizations available in that region.
1.19(c) The commissioner shall adopt efforts to attract and recruit immigrant worker
1.20populations from identified countries to immigrant worker enterprise zones. The
1.21commissioner shall request from Congress and the federal government an exemption from
1.22federal immigration quotas for countries identified by the commissioner.

2.1    Sec. 2. [299A.85] COORDINATION WITH DEPARTMENT OF HOMELAND
2.2SECURITY.
2.3When an individual becomes eligible for release from the custody of a state or local law
2.4enforcement agency and the Department of Homeland Security has issued an immigration
2.5detainer under Code of Federal Regulations, title 8, section 287.7, paragraph (d), the state
2.6or local law enforcement agency shall maintain custody of an individual with a United States
2.7criminal history for a period not to exceed 48 hours, excluding Saturdays, Sundays, and
2.8holidays in order to permit the assumption of custody of the individual by the Department
2.9of Homeland Security, regardless of whether the individual is eligible for bail.

2.10    Sec. 3. APPROPRIATION.
2.11$....... in fiscal year 2024 is appropriated from the general fund to the commissioner of
2.12employment and economic development for the immigrant worker enterprise zones in
2.13Minnesota Statutes, section 116L.991."
