1.12201.161 AUTOMATIC REGISTRATION OF DRIVER'S LICENSE,
1.13INSTRUCTION PERMIT, AND IDENTIFICATION CARD APPLICATIONS
1.14APPLICANTS.
1.15 Subdivision 1. Automatic registration. An individual who properly completes an
1.16application for a new or renewed Minnesota driver's license, instruction permit, or
1.17identification card, and who is eligible to vote under section 201.014, must be registered
to
1.18vote as provided in this section, unless the applicant declines to be registered.
1.19 Subd. 2. Applications. The
Department commissioner of public safety
, in consultation
1.20with the secretary of state, shall change
its the applications for an original, duplicate, or
1.21change of address driver's license
, instruction permit, or identification card so that the forms
1.22may also serve as voter registration applications. The forms must contain spaces for

2.9 Subd. 3. Registration. (a) The secretary of state shall determine whether the applicant
2.10is currently registered in the statewide voter registration system. For each currently
registered
2.11voter whose registration is not changed, the secretary of state shall update the voter's
2.12registration date in the statewide voter registration system. For each currently registered
2.13voter whose registration is changed, the secretary of state shall transmit the registration
2.14daily by electronic means to the county auditor of the county where the voter resides.
2.15 (b) If the applicant is not currently registered in the statewide voter registration
system,
2.16the secretary of state shall determine whether the applicant is 18 years of age or
older and
2.17a citizen of the United States and compare the voter registration information received
from
2.18the commissioner of public safety with the information on wards, incompetents, and
felons
2.19received from the state court administrator under sections 201.15 and 201.155, and
with
2.20data received from the commissioner of corrections under section 201.157, to determine
2.21whether the applicant is eligible to vote. If an applicant is less than 18 years of
age, the
2.22secretary of state shall wait until the applicant has turned 18 years of age to determine
2.23whether the applicant is eligible to vote. For each applicant the secretary of state
determines
2.24is an eligible voter, the secretary of state shall transmit the registration daily
by electronic
2.25means to the county auditor of the county where the voter resides.
2.26(c) Any data on applicants who the secretary determines are not eligible to vote are
2.27private data on individuals, as defined in section 13.02, subdivision 12.
2.28 Subd. 4. Notice. Upon receipt of the registration, the county auditor shall mail to the
2.29voter the notice of registration required by section 201.121, subdivision 2.
2.30 Subd. 5. Effective date. (a) An application for registration that is dated during the 20
2.31days before an election in any jurisdiction within which the voter resides is not
effective
2.32until the day after the election.
2.33(b) An applicant for a Minnesota driver's license, instruction permit, or identification
2.34card must not be registered to vote until the commissioner of the Department of Public
3.1Safety has certified that the department's systems have been tested and can accurately
provide
3.2the necessary data, and the secretary of state has certified that the system for automatic
3.3registration of those applicants has been tested and is capable of properly determining
3.4whether an applicant is eligible to vote.
3.5(c) The secretary of state must absorb any costs associated with implementation of
this
3.6section using existing appropriations provided to the secretary by law."
